    Mar del Plata reconoce la habilitación comercial de los GrowShops como tienda de cultivo dedicadas al asesoramiento

    De esta manera, se convierte en el tercer municipio de Argentina en regular la actividad.

    El Concejo Deliberante del Partido de General Pueyrredon, que comprende las ciudades de Mar del Plata y Batán, aprobó los GrowShops como tiendas de cultivo dedicadas al asesoramiento y venta de productos para el cultivo de Cannabis.

    El Concejal Daniel Núñez fue el impulsor de la iniciativa y, tras su aprobación, afirmó que se trata de un reconocimiento “oficial” para el sector comercial y productivo vinculado al cannabis.

    “Implica una facilidad, hoy los emprendimientos del tipo Tienda de Cultivo o Grow Shop a la hora de solicitar la habilitación comercial se encuentran en la obligación de buscar un rubro (y muchas veces más de uno) asimilable al perfil de lo que van a vender para estar en regla”, explicó Núñez en diálogo con Cannabica.

    El funcionario señaló que con la promulgación de esta ordenanza, la habilitación va a ser más sencilla porque “la actividad va a estar reconocida dentro del nomenclador que dispone nuestro Código de Ordenamiento Territorial y facilita el trámite e incluso podría abaratarlo”.

    Desde la Cámara Marplatense del Cannabis fueron promotores de la ordenanza y la fueron desarrollando mediante la consulta con la comunidad, incluyendo a propietarios de grow shops, expertos en la materia y concejales.

    Diego Nutter, presidente de la Cámara, indicó que la ordenanza fue uno de los primeros objetivos que se propusieron cuando se conformaron durante 2022 y que lograr ponerlo en agenda y que se apruebe fue “muy gratificante”.

    “Lo que discutimos al conformarnos fueron las cuestiones que pudieran ayudar al rubro y a los usuarios y esto fué de los primeros temas que salieron”, aseguró el también director de la empresa Fenix Cann. “La idea era hacer crecer el rubro comercialmente y que a los usuarios se nos siguieran regularizando los derechos”, agregó.

    Nutter destacó además el trabajo realizado por el municipio y la rapidez con la que se aprobó la ordenanza. También afirmó que como dueño de un Grow Shop toma la aprobación de la iniciativa como “un reconocimiento al rubro y a un gran avance social”.

    “Esto demuestra que la sociedad en general y los legisladores en particular, que suelen ser los más reacios a los cambios, están viendo en el movimiento cannábico algo que no conocían y sobre lo que se había mentido durante tanto tiempo”, concluyó.

    Dos malos antecedentes 

    A principios del mes de septiembre, el Concejo Deliberante de Villa de Las Rosas, Córdoba, sancionó la Ordenanza 1585/23 que prohíbe en la localidad la radicación de todo establecimiento comerciales donde se brinde asesoramiento y se venda elementos que posteriormente puedan ser utilizados en el cultivo de cannabis, como iluminación, fertilizantes, medidores de ph, equipos de ventilación, equipos para cultivos en interior como también sus conexos. 

    Ante la situación, la Cámara Empresarial de Grows y afines de Argentina y la asociación civil de Grow shop de Córdoba se expresaron al respecto y repudiaron la medida.

    Más atrás en el tiempo, a mediados de 2022, durante el mes de octubre, el Concejo Deliberante de San Miguel prohibió los growshops y la difusión de información sobre el cannabis, a contramano de la ley nacional. 

    Durante el mes de agosto de ese año en esa misma localidad clausuraron el growshops Jardín Primitivo por vender sustrato “para cannabis”. Un mes después, y por decisión de la jueza Graciela Garcete, se levantó clausura, “justificando el derecho a trabajar y entendiendo que no había motivos ni una respuesta concreta del municipio para continuar cerrado”.
