Sucedió el jueves 20 de enero en la casa de Berta Thachek, presidenta de la Asociación Civil Cannabis Terapéutico Puerto Madryn. En simultáneo otro robo se dio en el predio del CONICET-CENPAT, a 6 kilómetros de distancia. En total se llevaron más de 70 plantas en vegetación.
La tormenta y ráfagas de viento, que azotaron a la provincia de Chubut, no detuvieron el accionar de los delincuentes que treparon el muro de tres metros que delimita el patio de Berta Thachek. Mamá de Salomé -23 años- con diagnóstico de encefalopatía crónica de origen no evolutivo y síndrome de Tourette, a quien suministra aceite de cannabis desde 2015.
“Esta vez solamente llegaron hasta el patio y no ingresaron al quincho. Voy a tener que tomar más medidas de seguridad, como el cercado eléctrico. Primero está la salud de mi hija”, expresó Berta Thachek, apellido de origen ucraniano, en conversación con Cannabica Argentina. No es el primer hecho delictivo que sufre, en 2020 y 2021 también tuvo que padecer el robo de sus plantas y hasta han llegado a ingresar al quincho donde tiene un indoor.
Berta cultiva en el patio de su casa, como muchas madres que preparan el aceite medicinal para mejorar la calidad de vida de sus hijes, y ponen la valentía de enfrentar la ausencia estatal, la persecución policial, el prejuicio social, y también la inseguridad local. El caso de Berta, sentó un precedente porque consiguió en 2019 que se aprobará su recurso de amparo contra el Estado Nacional y fue autorizada a cultivar hasta 25 plantas en domicilio, sin alcance o vista de terceros.
Este jueves, al regresar de San Antonio Oeste, donde había asistido con un grupo de madres para obtener una nueva genética rica en THC, se encontró con el robo de sus 60 plantas, todas en vegetación, de dos metros de altura con predominancia de cepas altas en CBD como Banana Kush, Moby Dick y Sweet Dream.
En la misma madruga, se produjo el robo de 12 plantas al Centro Nacional Patagónico (CENPAT) del CONICET, que días previos había sido visitado por la ministra de Salud, Carla Vizzotti. Las plantaciones del predio tienen la finalidad de avanzar en investigación, para poder brindar análisis de los distintos aceites a la comunidad.
Las madres, símbolo de la lucha por el cannabis medicinal en Argentina, trabajan en conjunto con los y las médicas, paso a paso para evaluar cómo responde cada paciente a las distintas genéticas. “No por tener el mismo diagnostico a todos les responde el mismo tratamiento. Vamos cambiando las composiciones variando genéticas. Por lo general el CBD ayuda a evitar las crisis, en cambio el THC da mejoras en las reacciones, estímulo para hacer cosas, promueve el habla, entre otros beneficios”, explica Berta. Hoy Salomé tiene 23 años, ya no toma pastillas y gracias al aceite de cannabis no padece más convulsiones.
En su caso en particular, por lograr el primer amparo judicial de la provincia, Berta pudo hacer la denuncia y esta mañana le informaron de allanamientos realizados que dieron con sus plantas, obviamente que ya no le sirven por el daño al cortarlas y la manipulación. Pero muchas otras madres, con inconvenientes para obtener el permiso de REPROCANN, o que por otros motivos no lo han tramitado, permanecen sin poder denunciar estos robos.
La lucha por el amparo judicial
En 2015 Berta decidió viajar a una clínica en Guaymallén, Mendoza, desde donde le había llegado información que estaban tratando a una niña con la misma patología que Salomé, con cannabis medicinal. Pidió licencia en sus dos trabajos, como auxiliar en un colegio por la mañana y a la noche como servicio de cuarto en un hotel, para poder emprender con Salomé lo que sería un nuevo mundo y transformaría sus vidas, cannabis medicinal.
Las primeras dos gotas de aceite, dieron el primer resultado positivo, por primera vez en años, Salomé pudo descansar sin sobresaltos y Berta entendió que había un renacer. De allí en más, emprendió la lucha por mantener el tratamiento de su hija.
De vuelta en Chubut, seguían recibiendo el aceite vía encomienda Mendoza-Córdoba, pero un operativo de Gendarmería en Viedma secuestró los goteros. Esa fue la primera lucha de una batalla que Berta no tenía planeada en su rutina. La causa cayó en un juzgado de Viedma, al cual se solicitó el sobreseimiento de Berta y la restitución de los goteros. Diez días después fue llamada a declarar. Gracias a las gestiones de Marcelo Sánchez, de la Defensoría Federal de Viedma, estaba libre de cargos y podía volver con sus aceites. Mirta Filipuzzi, jueza responsable del fallo, la felicitó por el progreso de su hija y le comentó sobre el derecho a presentar un amparo en su provincia para que ella pudiera desarrollar su cultivo. No todos los jueces y juezas se niegan al cambio de paradigma sobre el cannabis.
Así fue que, en 2018, Berta impuso un recurso de amparo contra el Estado Nacional para ser habilitada en el cultivo de cannabis con fines medicinales para evitar la persecución por violación a la Ley de Drogas 23737. En febrero de 2019 el titular del Juzgado Federal de Rawson, Hugo Ricardo Sastre, dio lugar al amparo y Berta sentó un precedente histórico en Chubut: era la primera mamá que conseguía una habilitación para sembrar, cultivar y procesar sus propias plantas con fines medicinales. La resolución le permitía -le permite- tener hasta 25 ejemplares en su domicilio, fuera del alcance y vista de terceros.

A partir de su lucha, Berta consideró que era necesario continuar para poder ayudar a más personas que requieren cannabis para su dolor, pero que no cuentan con información, asesoramientos técnico y legal. Por lo cual, junto a otros pacientes y profesionales, conformaron la Asociación Civil Cannabis Terapéutico.
Asociación que hoy cuenta con 40 médicos para recetar y controlar el avance de los tratamientos, cinco madres que preparan los aceites y las cremas, y más de 400 familias que se abastecen gratuitamente de esa producción. Además integran el Consejo Consultivo de Cannabis Medicinal de Puerto Madryn, junto a médicos, legisladores, miembros del CONICET, abogados y concejales
Para certificar calidad, la Asociación envía su producción al laboratorio local BioMadryn, que a su vez lo manda a analizar a Bahía Blanca. Luego se informa a los y las médicas con qué material se dispone para que ellos puedan recetar adecuadamente.
Actualmente la ONG, aguarda que el Registro del Programa de Cannabis (REPROCANN) habilite la opción para inscribirse como organización, ya que son varias las madres que aún no pudieron obtener la licencia, no poseen un amparo, y solo la respuesta: “su caso está en análisis”. Ante la consulta de este medio a organizaciones sociales que integran el Consejo Consultivo del Registro, informaron que se están ultimando detalles con el ministerio para poner en marcha la opción.
Cultivo a gran escala en Chubut
El gobierno de Chubut avanza con dos proyectos para ampliar, promover y satisfacer la demanda de cannabis medicinal en la provincia. Por un lado el Ejecutivo, envío un proyecto la Cámara de Diputados para conformar una Sociedad del Estado, como ya cuentan provincias como Jujuy y San Juan, para regular su producción, investigación y eventual industrialización.
Y a su vez, está a punto de concretarse la entrega de los famosos “contenedores” prometidos por el ministerio de Seguridad de la provincia a la Asociación Civil Cannabis Terapéutico, para producir cannabis a escala en el predio de la Policía Montada local. La Asociación ya cuenta con las plantas requeridas para comenzar el cultivo.
