    Insólito: Prohíben la actividad comercial y de asesoramiento a Grow Shop en una localidad cordobesa

    El Concejo Deliberante de Villa de Las Rosas de la provincia sancionó una ordenanza para prohibir los locales dedicados a la comercialización y asesoramiento para el cultivo de cannabis.  La Cámara Empresarial de Grows y afines de Argentina y la asociación civil de Grow shop de Córdoba repudiaron la medida.

    El Concejo Deliberante de Villa de Las Rosas, Córdoba, sancionó la Ordenanza 1585/23 que prohíbe en la localidad la radicación de todo establecimiento comerciales donde se brinde asesoramiento y se venda elementos que posteriormente puedan ser utilizados en el cultivo de cannabis, como iluminación, fertilizantes, medidores de ph, equipos de ventilación, equipos para cultivos en interior como también sus conexos. El documento fue dictaminado el pasado 26 de julio de 2023.

    Ante esta situación, desde la Asociación Civil de Grow Shops y Cannabicultores repudiaron la ordenanza de la Municipalidad de Villa de las Rosas y pidieron no quedarse de brazos cruzados.

    “Esta ordenanza prohíbe rotundamente la operación de los Grow Shops en su territorio quedando estrictamente vedada la apertura de establecimientos comerciales cuyo enfoque sea el asesoramiento y venta de productos esenciales para el cultivo de cannabis”, explicaron desde la asociación civil.

    Según detallaron, el documento prohíbe desde semillas hasta fertilizantes, medidores, herramientas, equipos de ventilación, entre otros elementos y además afecta a médicos, investigadores, productores y “personas encargadas del fitomejoramiento tan necesario para usuarios y pacientes” del área cannábica.

    Los integrantes de la asociación civil expresaron que se trata de un “contrapunto” a las normativas nacionales vigentes y una contradicción habiendo leyes nacionales como la 27350 (cannabis medicinal) y la 27699 (sobre la regulación de la industria).

    “Sigamos luchando por un futuro donde la regulación y la tolerancia se unan para garantizar un espacio justo y equitativo para todos”, concluyeron en el comunicado difundido.

    Por otro lado, la Cámara Empresarial de Grows y afines de Argentina (CAMEG) mostró también su rechazo a la medida tomada por la Municipalidad de Villa de Las Rosas y afirmaron que se trata de una falta de “entendimiento, por parte de los ediles sobre las distintas normativas que hoy por hoy acompañan este tipo de actividad”.

    Así detallaron en su repudio que el derecho a trabajar, la libertad  de expresión, el derecho a acceder como el de difundir información “constituyen garantías amparadas en los artículos 14 y 75 (inciso 22) de la Constitución Nacional”. 

    Además, recordaron que varias localidades del país dictaron varias ordenanzas por las cuales se habilita la apertura de dichos espacios, con reconocimiento legítimo por parte de los municipios.

    “CAMEG invita a la ciudadanía a acercarse a los distintos espacios cannábicos de Villa de Las Rosas para desterrar el tabú o miedo que la palabra cannabis les pueda generar”, indicaron y aseguraron que es preciso que se dialogue con los distintos profesionales de la salud y otros ámbitos donde el cannabis “hoy encuentra reparo gracias a la legislación vigente”.

    No es la primera vez que sucede algo de esta índole, a mediados de 2022  el Concejo Deliberante de San Miguel prohibió los growshops y la difusión de información sobre el cannabis, a contramano de la ley nacional 27350 de uso de cannabis medicinal.

    Dicho documento, con un espíritu que desconocía toda la legislación nacional en la materia, la ordenanza detallaba: “ratifica la prohibición de la comercialización y/o venta de parafernalia/elementos destinados al consumo recreativo de Cannabis, (…) así como la venta de instructivos tendientes a asesorar acerca del cultivo de Marihuana e insumos para facilitar su producción”.
