    El Estado aumenta la carga de THC y la comunidad cannábica rechaza la criminalización: Así fue la Expo Cannabis Uruguay 2022

    Con una importante participación internacional, altas dosis de entretenimiento y una oferta comercial para todos los gustos, se llevó a cabo la novena edición de la Expocannabis Uruguay 

    El pasado del 2 al 4 de diciembre la novena edición de la Expocannabis Uruguay en el parque del Laboratorio Tecnológico del Uruguay (LATU) de la ciudad de Montevideo con la asistencia de unas 20.000 personas.

    A ritmo de candombe, la feria abrió sus puertas con la primera atracción del día, el partido Uruguay-Ghana transmitido por la pantalla instalada en la Fan Fest del evento, que repitió todos los partidos del fin de semana.

    En 2023 el candombe uruguayo dejará espacio para la samba brasileña tras el anuncio de la primera ExpoCannabis Brasil, que tendrá lugar en Sao Paulo los días 15, 16 y 17 de septiembre.

    El golpe sufrido el viernes por la celeste, que ganó pero quedó prematuramente eliminada del mundial, fue contrarrestado por un anuncio por parte del Instituto de Regulación y Control del Cannabis (IRCCA): a partir del 20 de diciembre, estará disponible en las 30 farmacias habilitadas la nueva variedad gamma de marihuana, que contará con más THC (tetrahidrocannabinol) que las dos variedades disponibles hasta el momento.

    “Esta tercera variedad, de alguna manera, va a tener un nivel de THC, o elemento psicoactivo, menor o igual al 15%; por lo tanto, se estaría acercando mucho más a lo que muchos clientes o personas estaban demandando. Se asemeja mucho más a los niveles de THC que se pueden tener en los clubes. Eso era un debe muy importante”, informó el director ejecutivo del IRCCA, Juan Ignacio Tastás.

    El jerarca también adelantó que están “elaborando una cuarta variedad, que posiblemente esté lanzándose sobre diciembre del año que viene” y que se analiza cómo garantizar el acceso universal, lo que podría habilitar el acceso de cannabis a extranjeros.

    “Estamos 100% de acuerdo de que tiene que haber una normativa que se modifique legislativamente para que cualquier persona dentro del territorio nacional mayor de 18 años pueda acceder al cannabis mediante los canales legales y reducir ese mercado gris que hoy existe”, planteó a su vez Gonzalo Maciel, del Ministerio de Industria, Energía y Minería.

    Del gris de la regulación al blanco de la criminalización

    Uno de los platos fuertes del evento a nivel de conferencias fue la que reunió a María José Miles (Federación de Clubes Cannábicos), Julio Rey (Asociación de Autocultivadores), Juan Manuel Varela (Asociación de Grow Shops y Comercios Afines), Rodrigo Charlo (IRCCA) y el abogado Martín Fernández.

    En el panel, que se enfocó en la actual situación regulatoria, hubo acuerdo en la necesidad de eliminar la figura jurídica ambigua de «tenencia para no consumo», que «favorece la criminalización» de las personas que no están dentro de los márgenes de tenencia que establece la ley, pues las fiscalías «la utilizan para perseguir», según el abogado Fernández.

    «Esto es un error, porque lo que ha querido hacer la ley es separar las actividades: las destinadas al narcotráfico y las destinadas al uso personal o doméstico, que no deberían ser criminalizadas porque corresponden a la autonomía personal. Basta con que se apliquen penas administrativas», agregó.

    El representante de autocultivadores, Julio Rey, estuvo de acuerdo: «Estamos siendo expuestos como colectivo a una persecución sistemática. Mucho tiene que ver con la política de drogas del actual Ministerio del Interior y de algunas fiscalías, y el combate al microtráfico con énfasis en cannabis.

    Hay una inversión del principio de inocencia: hoy cuando un fiscal acusa, se constituye automáticamente un delito y se constituye la preventiva».

    Rey atribuyó gran responsabilidad de esta realidad al nuevo marco regulatorio habilitado por la Ley de Urgente Consideración (LUC) aprobada al inicio del mandato de Lacalle Pou, pero también al nuevo Código del Proceso Penal, que es anterior e introduce el juicio abreviado, a partir del cual «algunos jueces lo utilizan como herramienta extorsiva, se acusa o formalizar a un familiar y la persona, por desconocimiento o reaccionando bajo presión, termina abrazando la bandera», explica.

    «Trabajamos sin seguridad jurídica», agregó Varela por parte de la asociación de grow shops. «Estamos a una situación donde la marihuana no llega a todo el país, no hay el mismo acceso en todos lados. Se podría generar mucho dinero en impuestos, pero el estado está dejando de lado esa posibilidad. Según la encuesta nacional, tenemos 109.000 consumidores habituales de cannabis. A 1 gramo por día estamos hablando de unas 50 toneladas, pero el mercado regulado cubre 5 toneladas. Está quedando mucho para el mercado negro, por problemas resultantes de leyes relacionadas con la seguridad. Hay una inequidad porque no todos podemos acceder a la posibilidad de comercializar cannabis», comentó.

    El acceso, el empoderamiento de los microproductores y una mejor distribución fueron otros aspectos de consenso. «Hoy, los clubes pueden tener hasta 45 socios, entre los que reparte su producción. Un problema es que, sí o sí, los clubes precisan que los socios se lleven 40 gramos todos los meses, por un tema de costos. Quizás sea más de lo que precisen: no es una buena política de salud e inhibe a otras personas acceder al sistema. Lo ideal sería pensarlo en una lógica de producción y no de personas. Creemos que eso quedó desactualizado», expresó María José Miles, en representación de los clubes.

    Psicodelico-terapia

    Los nombres de Stanislav Grof, el psiquiatra checo creador de la Psicología Transpersonal, y de Claudio Naranjo, referente chileno de la combinación de psicoterapia con psicodélicos, también estuvieron presentes en las conversaciones de la Expocannabis, en este caso impulsados por la SUPAP (Sociedad Uruguaya de Psicoterapias Asistidas por Psicodélicos y Enteógenos).

    «Con la terapia psicolítica impulsada por Grof, que combina psicoterapia con psicodélicos, se aceleran los procesos para llegar más rápido al origen de los traumas de los pacientes, y por consiguiente de sus psicopatologías», comentó Javier Charme, psicólogo miembro de la Grof Legacy Training, quien abrió el foro sobre perspectivas en psicoterapias asistidas con psicodélicos, también denominados enteógenos.

    Varios psicólogos pudieron continuar intercambiando conocimiento dentro de un área que fue prácticamente suprimida a mediados de la década de los setentas, a partir de la imposición del paradigma prohibicionista y el corte de fondos para la investigación sobre los potenciales de cura presentes en diversas sustancias, también llamadas «psicointegradoras».

    Provenientes de diversas líneas de trabajo, los panelistas coincidieron en que, contando con una metodología segura de trabajo, la inclusión en procesos terapéuticos de agentes como la ayahuasca, los hongos o el LSD, pueden resultar «atajos» que aceleran la cura de los pacientes.

    «El psicodélico trabaja la disolución del ego. No lo desaparece, sino que nos permite elegir cómo y cuándo utilizarlo. La libertad reside en aprender a despegarse y poder elegir movimientos nuevos. El ego es una construcción defensiva adaptativa, una herramienta que usamos en la lucha por la vida. Y está tan instalada que creemos que somos nuestro ego, cuando en realidad corresponde a un 15% de nuestro potencial», aseguró Magela Giorgi, quien destacó al eneagrama, herramienta propuesta por Claudio Naranjo, como otro de los «atajos posibles del autoconocimiento» para «trascender la fijación del ego».

    A su vez, actualizándonos sobre las tendencias actuales de la psicoterapia psicodélica, Federico Montero comentó que la misma disputa del el siglo XX entre escuelas que querían imponer su modelo de cura de la psiquis (psicoterapia, cognitivo-conductual, humanismo, transpersonal) está ocurriendo actualmente con los psicodélicos.

    «Mi apuesta es a la integración de modelos para abordar el trauma y responder a la pregunta: ¿cómo hacer para reducir el sufrimiento?», expresó. Según Montero, lo importante es que un tratamiento con psicodélicos respete los pasos de consentimiento informado, evaluación del estado mental y físico del paciente, y conceptualización del caso para establecer el tratamiento. Luego, viene la parte de la experiencia, en la que estas sustancias tienen el poder enfrentar al paciente con sus traumas, dolores y angustias, un momento para el cual es clave estar preparado y acompañado.

    «Los enteógenos incrementan la capacidad de procesamiento consciente, permiten acceder a nuevas experiencias en la conciencia. Así, nos permiten liberar la energía derivada del postrauma, que no había sido liberada en su momento, y abre espacios para nuevas potencialidades en la persona», asegura.
