    Prohiben los grow shop en San Miguel

    El Concejo Deliberante de San Miguel prohibió los growshops y la difusión de información sobre el cannabis, a contra mano de la ley nacional.

    La semana pasada tuvo lugar un hito -bochornoso- en la historia de la “política de drogas” del municipio bonaerense: la prohibición de los growshops y de la difusión de información sobre el cannabis que acaba de aprobar el Concejo Deliberante de San Miguel.

    Con un espíritu que desconoce toda la legislación nacional en la materia, la ordenanza “ratifica la prohibición de la comercialización y/o venta de parafernalia/elementos destinados al consumo recreativo de Cannabis, (…) así como la venta de instructivos tendientes a asesorar acerca del cultivo de Marihuana e insumos para facilitar su producción”.

    Es decir: se prohíben elementos que no están prohibidos y acciones (informar sobre cultivo) que no son ilegales en la Argentina.

    Antecedente en el municipio

    Mauro Benedetto y su socio Matías Toborga, dueños de la tienda de cultivo Jardín Primitivo, sufrieron en carne propia el sello prohibicionista de este municipio bonaerense, en varias oportunidades. La última fue cuando a principios de este año el local fue clausurado por la Municipalidad, literalmente, por exhibir una bolsa de tierra.

    Los growshops son espacios que brindan insumos y asesoramiento para el cultivo de cannabis, un derecho consagrado tanto por la Constitución como por la ley nacional de Cannabis Medicinal (27.350), cuando Benedetto y Toborga inauguraron su local todavía no existía el marco a nivel nacional.

    Por eso gestionaron los permisos como «vivero» con diferentes subrubros como parafernalia, fertilizantes e iluminación para cultivo de interiores.

    «Lo que diferencia a una tienda de cultivo de un vivero es el asesoramiento al cultivador de cannabis. Hay que tener en cuenta que la mayoría de los fertilizantes que se usan para la planta de cannabis se pueden usar para cualquier otra planta, por ende los que se usan para otra planta pueden servir para cannabis.

    Pero lógicamente el objetivo es que cumplan parámetros de seguridad: no ser tóxicos, que no dejen residuos en el individuo de la planta para que puedan contaminar los extractos o afectar a las personas», distingue Benedetto.

    A mediados del año pasado el Municipio de San Miguel, ya les había impuesto un cese de actividades sin multas, que se dio también en el contexto de un alza del discurso prohibicionista en San Miguel, municipio que en comunicaciones oficiales se declara «hostil a la droga».

    «Nos hicieron un cese de actividades porque no teníamos habilitada la venta de parafernalia, cuando fuimos a hablar a la Subsecretaría de Control y Ordenamiento Urbano, su titular, Mariano Calvente, nos dijo que él quería ‘cannabis cero’ en el municipio», indicó el dueño.

    «Entonces le contamos que existía la ley 27350 -Ley de Investigación médica y científica del uso medicinal de la planta de Cannabis y sus derivados- que habilita a quienes lo necesiten o lo deseen, con el aval de un médico y en la órbita del Ministerio de Salud, a cultivar», detalló Benedetto.

    «Esta persona no solo no conocía la ley, sino que nos trató de un modo tremendamente prepotente, militar, diría, con gritos y sin dirigirle siquiera la mirada a nuestra abogada Laura Fechino», aseguró el encargado de la tienda.

    Bolsas de sustrato.

    Historia de una persecución

    Benedetto describe la sucesión de encuentros con la autoridades municipales como la historia de una persecución: «Unos cinco meses después de aquel primer episodio, es decir, esa reunión en la que el titular de la Subsecretaría de Control y Ordenamiento Urbano, Mariano L. Calvente, nos dijo que ‘lo iba a pensar’ y nos permitió seguir trabajando con parafernalia, nos cayó una inspección.

    «Un viernes nos dijeron que estaba todo perfecto y el siguiente lunes nos cae otra. Yo filmé toda la situación, que se viralizó». En el video se lo escucha a un inspector amenazar con la clausura por dos supuestas denuncias anónimas de vecinos que aseguran que en el local se vende cannabis.

    «Yo le digo en el video al inspector que eso es mentira porque si esas denuncias existieran le hubiera correspondido venir con una orden de allanamiento y punto. Entonces lo invité, de buena fe, a que revisara y requisara todo el local. Y no encontraron nada», dice Benedetto.

    Después de estar una hora dando vueltas -cuenta Benedetto-, el inspector encontró en el piso una bolsa que decía «sustrato para cannabis», amenazó con clausurar y Benedetto volvió a filmar la escena: «le digo que estoy autorizado para cultivar, pero que más alla de eso, lo que tiene la bolsa es tierra, que se puede usar para una planta de tomate».

    El hallazgo de la bolsa de tierra derivó en una clausura de 45 días. Para tomar ese tipo de medidas debe haber algo dentro del local que ponga en riesgo la «seguridad de la comunidad» o tendrían que haber encontrado, durante un allanamiento, una sustancia ilegal. Pero no ocurrió ninguna de las dos cosas.

    «Nos clausuran sin motivo, entonces, fuimos a un juzgado de faltas». Y la jueza finalmente expidió un fallo -asombroso- en el que manda a las autoridades municipales a informarse y sugiere que se pongan a trabajar en una ordenanza para regular el tema.

    Además, solicitó que llamen a los diferentes actores participantes «porque estaba por instrumentarse la ley de industria del cáñamo y que el cannabis estaba teniendo muchos progresos y que necesitaban informarse al respecto».

    La jueza en ese fallo se expide acerca del pedido urgente de apertura del local, pero no acerca de la cuestión de fondo, es decir, si es legal o no la venta de sustrato para cannabis, es decir, una mezcla -a base de tierra, fibra de coco, perlita, humus-, que en rigor se puede usar para cultivar cualquier planta.

    -La jueza ordenó que las autoridades diseñarán un marco regulatorio que faltaba en San Miguel. Pero el resultado de eso fue una ordenanza que prácticamente prohíbe el acceso a la información, la venta de instructivos de producción de cannabis y toda la parafernalia de cannabis recreativo…

    -Hicieron una ordenanza prohibicionista y dejando en claro la postura del municipio pero frente a la ley nacional no les quedó otra alternativa que excluir de la prohibición a quienes estamos autorizados por el Gobierno nacional.

    Los argumentos mencionados en la ordenanza que se aprobó son tristes. Para alguien que lleva estudiando años esto para poder agilizar con criterios razonados y fundamentados es bastante deprimente.

    Existen tantos contenidos científicos y organismos tan respetables como los que pertenecen al Ministerio de la Salud para asesorarse… y, sin embargo, no lo hicieron. Sólo se basaron en sus prejuicios.

    Quienes escribieron la ordenanza en San Miguel no están a la altura, o tienen otros intereses. No hay que olvidar que hace unos meses en San Miguel le dieron una medalla a Aldo Rico.

    Tampoco olvidemos que es un municipio que no garantiza el acceso al aborto y ni a la ESI en las escuelas. El Opus Dei tiene una bajada muy fuerte sobre el Consejo Deliberante y sobre el intendente.

    -¿Y por qué es una urgencia algun instrumento de regulación en consonancia con las leyes nacionales?

    -En San Miguel, desde 1970 no existe una habilitación como sí hay en otros municipios de Buenos Aires, que tienen ordenanzas que te permitan la venta de parafernalia, es decir, que regulen la venta de accesorios para fumadores.

    La ley de tabaco, por ejemplo, establece cuáles son los lugares donde se puede comercializar, dice que no se debe hacer publicidad, que en los ámbito institucionales educativos no se puede ofrecer, etc.

    El vacío legal le da la potestad a las autoridades de decidir con el dedo cuáles son los locales que pueden vender y cuáles no, sin ningún tipo de fundamento. Y lo hace en contra del principio legal que aclara que algo que no está prohibido, estás habilitado para hacerlo.

    -¿Y cómo sigue esta historia? Porque en teoría ahora deberían cerrar todos los growshops de San Miguel…

    -Nosotros hicimos todo legalmente como siempre y con la autorización del Estado nacional, INASE, vamos a comercializar a la gente que figura en el Reprocann semillas esquejes y todos los productos que se vinculan al cultivo de cannabis por las personas que estan autorizadas para cultivar y venderemos tierra sustratos y demas productos necesarios.

    Es absurdo pensar que puedo vender semillas y no puedo vender un triturador para hacer cigarrillos de cannabis. También sugiere la ordenanza que los medios de comunicación hacen un uso indebido de la figura de REPROCANN «incitando a consumir». Se citan estadísticas pero no se dice cuáles son las fuentes. Estadísticas fantasmas.

    San Miguel a contra mano

    Esta misma semana, en Estados Unidos, Joe Biden indultó a quienes estaban privados de su libertad por poseer cannabis. Se trata de unas 6500 personas condenadas por la tenencia de esta sustancia penada por las leyes federales de ese país.

    Fue un importante paso hacia la descriminalización, en el marco de un proceso global, en el que se incluye también el know how cultivador que desde hace años crece en Argentina y pone en marcha a la industria cannábica, en la que confluyen cultivadorxs, usuarixs, criadores de semillas, clubes de cultivo, grow shops, distribuidoras, asociaciones civiles.

    La Ley de cannabis medicinal y cáñamo, aprobada en mayo de este año, es una respuesta a ese crecimiento porque establece un marco regulatorio para el desarrollo de la industria del cannabis medicinal y el cáñamo industrial, y promueve el desempeño de las cooperativas del sector y de las PyMEs.

    Si bien sigue pendiente la regulación del uso adulto, la propuesta se suma a un clima de época de erosión del estigma sobre quienes consumen, en el cual se deja de ver al cannabis como un “producto diabólico”, para pasar a apreciar sus propiedades.

    Un clima que se extiende en la Argentina y el mundo, pero no ha hecho mella en el municipio de San Miguel.
