Mauro, uno de los dueños de la tienda «Jardin Primitivo Grow» denunció una “situación de persecución” en contra de su comercio en San Miguel, que este jueves terminó en su clausura luego de que un inspector hallara una bolsa de sustrato para cannabis en el local. “En la infracción él asume que nos clausuran por tierra”, reclama Mauro, quien impulsará una concentración pacífica el martes próximo frente a la municipalidad en protesta por la medida.
“Ahora estamos clausurados y perdiendo plata, en contexto de crisis económica y sanitaria, desocupación, inflación…”, lamenta el dueño del comercio ubicado en Muñoz 1539. El distrito que dirige el intendente de Juntos por el Cambio Jaime Méndez ordenó su cierre repentinamente este jueves, según cuenta Mauro. “El inspector dice que tiene órdenes del municipio y que todo lo que sea grow shop está relacionado con la venta de cannabis”, cuenta, al tiempo que detalla que su comercio no es un grow shop sino “una tienda de cultivo”.
No es el primer altercado legal que sufre: denuncia que, hace seis meses, el partido le reglamentó un cese de actividades por tres días. “El director de habilitaciones municipal Mariano Calvente nos pidió textualmente que dejemos de asesorar a la gente sobre cultivo de cannabis”, recuerda. Y agrega: “El municipio de San Miguel no comprende normativamente el rubro. Por ley está aprobado, pero la política según Calvente es ‘no cannabis’. Cree estar por encima de las leyes nacionales”.
La clausura de la tienda de cultivo y el avance judicial
El jueves, un inspector llegó a la tienda de cultivo en San Miguel con la presunta orden de clausurar el comercio. “No encuentra nada, sale y nos dice que igualmente nos tiene que hacer una clausura porque en nuestro cartel dice ‘grow shop’, lo cual es una falacia”, repudia el vendedor. Frente a la imposibilidad de propiciar la infracción por ese motivo, la pesquisa continúa.
El dueño relata: “Entonces el inspector encuentra una bolsa de sustrato de 25 litros, que es tierra, que dice ‘para cannabis’. Se aferra a eso, empieza a labrar el acta y nos dice que nos va a clausurar”. El comerciante asegura estar inscripto en el Registro del Programa de Cannabis (Reprocann) contemplado en la Ley 27.350, y que la tienda está habilitada como rubro de vivero. Sin embargo, el inspector certifica la clausura.
Ante ello, el viernes el vendedor se dirige al juzgado de faltas de San Miguel. “La jueza nos dice que tenemos que pagar la multa o nos daba la sentencia”, afirma. Mas el dueño opta por hacer un descargo el martes venidero. “Por el momento seguiremos clausurados. Yo no vengo a jugar. Si bien amo la vocación, esto es un laburo, tenemos empleados”, explica el comerciante.
La persecución a la tienda de cultivo
Por lo dicho, este fue otro incidente legal más entre los sufridos por la tienda de cultivo ubicada en Muñoz al 1500, San Miguel. Según el denunciante, el mismo inspector fue quien, medio año atrás, ordenó un cese de actividades al comercio. “Había artículos de tabaquería en el local y nos dijeron que nosotros no estábamos en regla. Estuvimos casi un mes vendiendo al 30% porque no teníamos mercadería”, menciona
En aquella oportunidad el dueño se dirigió al municipio para normalizar la situación. “Tuvimos una discusión muy fuerte en la que el director de habilitaciones Calvente asumió desconocer que hay una Ley 27.350 y una ley de derecho a la información que nos ampara nacional e internacionalmente. Pidió que dejemos de asesorar a la gente sobre cultivo de cannabis, pero el municipio no tiene ninguna forma de asesorar en lo que respecta a salud a ningún usuario”, repudia.
Finalmente, la seguidilla de cruces entre el dueño de la tienda de cultivo y la municipalidad acabó con el cierre del local esta semana. “Nos clausuraron por tener una bolsa de sustrato, que no es otra cosa que tierra, porque en su packaging dice ‘para cannabis’. Por eso estamos llamando a la concentración”, señala el comerciante.
La manifestación pacífica se desarrollará este martes en la plaza de San Miguel, frente al municipio del intendente Menéndez. “Esta es la situación de persecución por parte del sector de habilitaciones municipales, encabezado por Mariano Calvente. Invitamos a asociaciones e independientes a participar de la concentración”, cerró el vendedor de la tienda.

“De ninguna manera la existencia de los Grow Shop está prohibida, porque no comercializan productos prohibidos”, explica la abogada penalista y representante de la Cámara de Empresarios del Cannabis Córdoba (CECC), Nadia Podsiadlo.
A su vez, aclara que la municipalidad solo puede ingresar a clausurar un local si se comete alguna falta a la ordenanza municipal. “En este caso, si hay denuncias, debería haber actuado de manera judicial con orden de allanamiento y con policía”.
“La tierra no está prohibida, así sea utilizada para cannabis”, comenta la abogada. En la actualidad “está autorizado por resolución ministerial y un decreto ejecutivo, en base a las modificatorias de la 27.350, todo lo que haga a aquello cultivos controlados que son las personas que tienen REPROCANN”, explica la licenciada.
Además, agrega que también son alcanzadas aquellas personas que están autorizadas para investigación por el Ministerios de Salud y quienes están autorizados por el INASE como categoría A y H.
Por su parte, la abogada y Defensora Pública –oficial coadyudante, en Comodoro Rivadavia, Verónica Castillo, dice que es una muestra de un Estado incoherente y absurdo. “El estado municipal es a veces el que más presión impone sobre el ciudadano. Pueden ampliar derechos pero no disminuir”, explica.
Además, comenta que “es más fácil defenderse del código penal nacional que el municipal”. Porque para discutir una multa, en los juzgados de faltas están cubiertos por personal que no concursó, puestos políticos o directamente desconocen las normativas y terminan solo ofreciendo un pago voluntario. “Terminas pagando para no tener que discutir, porque sino tenes que apelar en el juzgado de falta y la resolución se discute en el Poder Judicial”, continúa. “Se termina pagando la multa, cayendo en la lógica recaudatoria del municipio”.
“Para discutir en el juzgado de faltas tenes que poner un abogado particular, porque no existe un abogado oficial ante el juzgado, tampoco existe un fiscal”, explica Verónica. “Es una estructura totalmente inquisitiva, es como la edad media, funcionan así”. La situación de indefensión en estos casos es seria, porque el mismo juez que impone la multa es quien te termina citando a resolver el caso. “Se vulneran los derechos del ciudadano”, comenta Castillo.
«Si no existe una ordenanza en el Municipio de San miguel que prohíba la venta de productos para cannabis no pueden intervenir. Y en el caso de existir sería ilegitima y habría que discutir su inconstitucionalidad», advierte Castillo, y a su vez opina que hay un estado municipal que no se instruye sobre conductas que antes eran delitos y ahora no lo son. “Es una falta de capacitación grave”, concluye.
