    Primer Congreso de Derecho Cannábico

    Organizado por la comunidad Yo Me Planto y llevado a cabo vía streaming a través de la plataforma YouTube, este lunes 30 de agosto se llevó a cabo el primer Congreso de Derecho Cannábico de Argentina. Este encuentro, conducido por el abogado Juan Manuel Palomino Uriarte, contó con la participación de diferentes especialistas que abordaron el derecho cannábico en cuatro módulos divididos por temas.

    Mara Brawer, Diputada Nacional (CABA) – Leandro Halperin, Legislado de Ciudad Autónoma de Buenos Aires

    En el primer módulo participaron Leandro Halperín, legislador de la Ciudad Autónoma de Buenos Aires, y Mara Brawer, psicóloga y Diputada Nacional por CABA, quienes abordaron el tópico “Políticas públicas y rol del Estado en materia de legislación”. Sobre este aspecto, Mara Brawer expresó que, pese a que aún existen algunas normas que penalizan la tenencia y el consumo del cannabis para uso personal, desde el Estado se está trabajando para avanzar sobre esta materia como ya lo ha hecho, por ejemplo, con la regulación del cannabis medicinal y con la regulación del cáñamo industrial, que ya tiene media sanción en el Senado.

    “La habilitación del Estado es el primer paso para que esta industria se desarrolle y para poder avanzar en los derechos que los ciudadanos exigen en relación a esta planta que tiene tantas funciones”, manifestó Mara Brawer, quien luego hizo referencia a los avances alcanzados hasta el momento. “El primer paso que hemos dado es el medicinal, ahora el paso de la industria y por supuesto queda el paso que es el que todos estamos esperando que es el de la despenalización”, sostuvo.

    Por su parte, Leandro Halperín expresó, desde una mirada complementaria a la de Brawer, que ve con buenos ojos que el Estado “se entrometa menos”, mencionando a la ley de cannabis medicinal como ejemplo, aunque señaló la importancia de discutir los ingresos “que el país pierde por no regular el cannabis a nivel industrial”.

    “El debate más importante no es si hay cannabis medicinal o si el recreativo es legal o no; el debate más importante es establecer hasta dónde dejamos al Estado entrometerse en nuestras vidas, qué puede prohibir y con qué herramientas hacerlo, y cómo educar para que cada quien con libertad elija qué hacer con su vida”, opinó Leandro Halperín.

    Luego, tras un breve intervalo,  en el segundo módulo, participaron del congreso los abogados María Victoria Baca Paunero y Luis Osler, miembros del Centro de Estudios de la Cultura Cannábica (CECCa), para discutir el tópico de “Políticas de drogas y derechos humanos”. Acorde al contexto del encuentro, los profesionales enfocaron el tema desde la perspectiva del “derecho cannábico”, concepto del que comenzó a hablar Luis Olser: “Más allá de que existe un activismo de hace décadas en Argentina, en realidad hay un punto de inflexión que es la presentación en UMET de Mamá Cultiva, por lo que eso generó”, comenzó el abogado.

    “Hasta el 2016 solo teníamos algunos fallos, en ese año se presenta Mamá Cultiva, en el 2017 la ley de cannabis medicinal y a partir de ahí para adelante legislaciones municipales, reglamentaciones, proyectos”, continuó Luis Osler, haciendo hincapié en que desde la llegada de las “madres” al activismo por el cannabis los cambios comenzaron a producirse. Asimismo, el abogado valoró todos estos pasos dados hasta el momento pero sostuvo la importancia de continuar hasta que haya una “regulación amplia que regule todos los usos del cannabis”. “Yo escuché hablar del uso medicinal, terapéutico, industrial, pero en realidad el derecho (importante) es el del usuario, que está antes que la categoría, el derecho que nos da la Constitución a elegir un modo de vida y a usar diferentes sustancias”, agregó.

    Luego, María Victoria Baca Paunero, además de coincidir con la postura de Osler, comenzó opinando sobre que “no es casual que los primeros abogados que están hablando sobre este tema sean los penalistas”. “Tendrían que estar hablando los tributaristas, los especialistas en sociedades, tendrían que hablar otro tipo de abogados”, lanzó la letrada, quien agregó que eso tiene que ver con la demonización del cannabis.

    “Las leyes de droga se utilizan con fines que no tienen nada que ver con el cuidado de la salud pública, que es el objeto que supuestamente tienen estas leyes”, agregó Baca Paunero, para luego hacer énfasis en la falta perspectiva sobre derechos humanos que hay en los aún delitos por tenencia de estupefacientes en comparación con otro tipo de actos delictivos.

    Diana Barreneche (Proyecto Cáñamo)- Adriana Friedheim (Abogada)

    En el tercer módulo, cuyo eje fue “Medioambiente e industria”, participaron las abogadas Adriana Friedheim y Diana Barreneche, y esta última comenzó a hablar sobre el tema en el que se especializa como es la agenda medioambiental y de desarrollo sostenible, y definió el concepto.

    “La sostenibilidad implica lograr un equilibrio entre lo económico, lo social y lo ambiental, porque el ser humano ya de por sí impacta de una manera diferencial en el ambiente y lo importante con esto es cómo vamos a hacerlo”, explicó Barreneche, y luego añadió que, debido a los distintos usos del cannabis, es importante pensar en políticas públicas que impacten de manera positiva en el ambiente.

    “Hay que incluir la mirada de sostenibilidad, que los Estados quieran empezar a regular y que los particulares podamos empezar a emprender con cannabis, tanto para un proyecto con cáñamo, como medicinal o lo que sea, hay que estructurarlo bien, hay que pensarlo bien”, agregó.

    Y finalmente, para cerrar el último módulo, participaron los abogados Ivana Vigilante y Facundo D’Espósito junto a Javier Hasse, fundador de El Planteo, abordando el tópico del “Emprendedurismo”, donde brindaron asesoramiento sobre aspectos elementales para emprender en este rubro, como por ejemplo distinguir lo que es una cooperativa de un tipo societario y una asociación civil.
