Desde marzo 2021 Argentina hizo foco en el cannabis medicinal y decretó la autorización del autocultivo, a través de la reglamentación de la ley 27350 del año 2017 ingresando en el conjunto de países más moderados en relación a políticas que permiten la utilización de esta planta.
Desde aquella iniciativa coordinada por el ministerio de Salud y firmada por el presidente Alberto Fernández, se autorizó el Registro Nacional de Pacientes en Tratamiento con Cannabis (Reprocann): de 1 a 9 plantas florecidas por persona (etapa en que la planta muestra su flor) y la posibilidad de circular con 1 y 6 frascos de 30ml con aceite o hasta 40 gramos de flores secas.
Esta política pública también atiende el reclamo crucial de las organizaciones no gubernamentales (ONG) que fueron las principales en reavivar constantemente el reclamo por la utilización de cannabis medicinal. La mayoría de ellas surgió de madres con hijos que padecen epilepsia refractaria, principal diagnostico donde el cannabis tiene mejores resultados que los tratamientos convencionales.
Hasta octubre 2023 se habían registrado 300 mil usuarios de cannabis medicinal y 42 ONGs a nivel país, cifras informadas por el ministerio de Salud. Las organizaciones tienen la posibilidad de incluir hasta 150 paciente y declarar más de un predio de cultivo. El trámite se realiza por el portal Mi Argentina, con la vinculación de un médico/a inscripto con el cual se haya realizado una consulta previa y posteriormente indicado tratamiento con cannabis.
Con la asunción del presidente Javier Milei, Argentina transita un recambio político y de funcionarios a nivel nacional. Con respecto a cannabis medicinal el nuevo gobierno no ha comunicado qué rumbo tomará: “Todavía no es un tema en agenda del ministro”, respondieron a este medio una fuente encargada de la comunicación del ministerio de Salud comandado por Mario Russo.
En los últimos días se registraron muchos reclamos de usuarios de cannabis medicinal con respecto a la renovación del Reprocann: “En mi caso la consulta de vinculación -por primera vez- con el médico e inicio del trámite lo realicé en noviembre del año pasado y aún figura en Pendiente de Evaluación”, indicó una paciente quien agrega que su pareja solicitó la renovación en junio y para agosto ya estaba aprobada.
A partir de abril 2023 el ministerio de Salud extendió la duración del registro de 1 a 3 años, ya para ese entonces la capacidad administrativa del programa se vio sobrepasada por la demanda de pacientes. La demora en la respuesta está establecida hasta 60 días hábiles, lo cuales en la mayoría de los trámites hoy se encuentran excedidos. Muchos de estos casos apelan a realizar un pedido de Pronto Despacho al ministerio para su respuesta, aunque sin éxito de igual forma.
Desde las ONGs la situación es similar, pasada la instancia de espera muchas decidieron acudir a la justicia mediante la Acción de Amparo. “La verdad es que hay mucha demora para ambas vinculaciones. No hay respuesta oficial desde el ministerio de Salud, no se están cumpliendo los 60 días hábiles”, explicó el abogado Nicolás D´Amico quien trabaja en representación de varias organizaciones cannábicas desde el estudio DPV Servicios Jurídicos y la cuenta de Instagram Tu Cannabis Legal.
“Con respecto a las ONG se están dejando vencer los pedidos de Pronto Despacho por eso estamos iniciando Amparos y tuvimos diferentes resultados: en algunos casos de asociaciones civiles las inscribían directamente; en otras no contestaban o en otras indicaban que faltaba algún formulario y le indicábamos que no era así que estaba presentando y después resolvían a favor”, comentó D´Amico y agrega que “no tienen un criterio unificado al contestar los amparos”.
Una ONG ya inscripta en el Reprocann, e integrante del último Consejo Consultivo Honorario del Programa, sufre la misma situación: “No nos están aprobando el ingreso de nuevos pacientes”, contó Mabel Canosa presidenta de Plantar y Crecer Libre organización que armó el consultorio cannabico en el Hospital Fiorito (Avellaneda) pionero en la red pública.
Desde la organización comentan que estarán elevando una carta al Programa exigiendo respuesta por los trámites sin respuesta, de pacientes y nuevas ONGs, que llevan más de 90 días. “A partir de Enero se cortó la comunicación la persona designada del Programa que nos respondía”, afirman desde la organización quienes además asesoran médicos para la vinculación y comentan que están en la misma situación sin respuesta por parte del ministerio.
Hasta el octavo piso del ministerio de Salud llegó este medio para consultar en la oficina del Reprocann por la situación del registro y fue atendido por una sola persona que se encontraba trabajando -la cual prefirió reservar su identidad- pero que estaba al tanto de las demoras. La explicación fue directa: “Se perdió el fin con el que se había pensado el Reprocann, en lugar de abastecer pacientes se está dispensando al público”. Fuentes cercanas al gobierno confirman off de récords que aún no hay personal designado y se tomarán los tiempos necesarios para auditar cada una de las solicitudes que lleguen.
En relación a la industria e investigación de cannabis medicinal varios organismos estatales como el Instituto Nacional de Semillas (INASE) o el Instituto Nacional de Tecnología Agropecuaria (INTA) funcionaron como auxiliares en los proyectos que luego recibían el visto bueno del ministerio de Salud. Al ser consultado los representantes designados para el tema cannabis de estos organismos, respondieron que desde diciembre no tuvieron nueva convocatoria a mesa de trabajo.
Sin embargo, quienes sí han recibido la convocatoria del gobierno por el tema cannabis medicinal fueron la Secretaría de Políticas Integrales sobre Drogas de la Nación Argentina (SEDRONAR) y Administración Nacional de Medicamentos, Alimentos y Tecnología Médica (ANMAT) para ser consultados a cerca del programa Reprocann y cómo debería continuar. Allegados a la convocatoria deslizan la idea del gobierno de armar listado de patologías más acotado del presente para la prescripción de cannabis medicinal.
El presidente Javier Milei no se ha expresado sobre la cuestión cannabis medicinal aún pero sí quien lo ha hecho, aprovechado el silencio del libertario, fue Patricia Bullrich. La ministra de Seguridad primerió la temática para resurgir un clásico de su gestión en la presidencia de Mauricio Macri: los allanamientos editados, con títulos resonantes y musicalizados al estilo Stallone.

A raíz de las demoras acontecidas muchos usuarios/as tienen dudas sobre qué pasará si ante el control de una fuerza policial les pueden objetar la presentación del registro. Para la abogada activista, integrante de la Consultora Cannábica Feminista, Nadia Podsiadlo, la norma no aclara que sucede en caso de demoras en la renovación y eso produce un gris a merced de su interpretación: “En definitiva queda librado a la voluntad y decisión de quién va a llevar la causa judicial en la fiscalía y juzgado de narcotráfico. Si te toca un/a operador/a que cumple con lo que dice la ley y lo que dicen las garantías no debería haber consecuencias legales, pero ¿qué pasa si te toca alguien que opine todo lo contrario? En este caso se violaría la igualdad ante la ley del art 16 CN en donde ante la misma conducta se decide de manera distinta”.
Para la Defensora Publica Oficial Coadyuvante de Comodoro Rivadavia, Verónica Castillo, la recomendación es no transportar cannabis en viajes de larga distancia: “El atraso en las aprobaciones solo es adjudicarle al Estado Nacional que está en mora ante pedidos que se hicieron hace 60 o 90 días. No obstante, aconsejo, por la escasa capacitación de las fuerzas policiales y de seguridad, no llevar consigo cannabis en trayectos largos que impliquen ingresos a otras provincias”.
Para los integrantes de la Red Federal de Abogados/as Cannabicos/as, toda acción o iniciativa que pueda ser realizada para comprobar que se trata de una demora por parte del Estado y no una infracción, sirve al momento de enfrentar el control de una fuerza de seguridad: “Quedan abiertas una serie de vías a las que recurrir para no estar del todo desprotegidos. O pedidos de pronto despacho a la autoridad administrativa para agilizar los trámites, o bien una acción judicial de amparo, para que el derecho del usuario de cannabis medicinal sea protegido en el caso concreto a partir de la intervención judicial”, expresó Marcos Chigal, abogado, especialista en derecho penal.
