    Federación Argentina Cannábica, la red de las organizaciones para plantarse en la industria del Cannabis

    La Federación de Organizaciones Cannábicas consolida en un estatuto formal la representación federal de las organizaciones. La cual tienen sus antecedentes en el movimiento cannábico del Frente de Organizaciones Cannábicas Argentinas (FOCA).

    En primera instancia la Federación buscará continuar relevando a las organizaciones de todo el país, para profundizar los focos productivos de las organizaciones en el Mapa, realizado por Lila Torre y Luciana Bruzzo del Universidad Nacional de la Plata, denominado Análisis Cartográfico e Histórico de la Cultura Cannábica en Argentina.

    La nueva Federación está constituida formalmente por las organizaciones: AUPAC (Rosario), Ciencia Sativa (Rio Negro), Acción Cannábica (Buenos Aires), Proyecto Cáñamo (Buenos Aires), Cogollos Córdoba (Córdoba) y Doing Canna (Buenos Aires). Hasta el 17 de septiembre recibirá formularios de adhesiones para las organizaciones que quieran participar en esta primera etapa.

    “Obviamente el territorio nacional es muy amplio, y seguramente puedan surgir otras Federaciones y está bien que así suceda por diferentes características y necesidades. Parte de este grupo inicial y de adherentes son los que van terminar de delinear el estatuto a construir colectivamente”, explica Soledad Pedrana, fundadora de Asociación de Usuaries y Profesionales para el Abordaje del Cannabis (AUPAC).

    Se estima que hay más de 100 organizaciones cannábicas activas y unos 30 proyectos de cultivos aprobados en el Estado y privados. En la actualidad en AUPAC participan alrededor de 40 personas entre usuarios y profesionales. Una organización que llegó a producir 20 kilos en su primer cultivo asociativo.

    Estos datos reflejan el peso de la historia del movimiento cannábico y organizaciones que reclaman el reconocimiento en el mercado de la industria que se aproxima: “La Federación pretende sentar representantes idóneos y verdaderos del movimiento. No concebimos que sean actores que están sentados en una mesa. Si todos los ministros van a llamar para hablar de una industria del cannabis a una Cámara que tiene tres días no entendimos nada”, apunta Pedrana y agrega: “Ya hay gente produciendo, copas y usuarios terapéuticos hace más de 20 años”.

    “Como organizaciones necesitamos tener nuestro propio espacio que nos represente verdaderamente. A la hora de hablar de producción, los representantes tienen que ser otros. Y ese polo productivo es el que reúne la Federación”, comenta Roxana Aguirre, representante de Ciencia Sativa.

    En el caso de la ONG Ciencia Sativa logró un convenio con el INTA en 2021, para cultivar dos hectáreas en un predio del organismo ubicadas en Guerrico, provincia de Río Negro.

    Las recientes declaraciones del presidente de la Cámara Argentina del Cannabis, Pablo Fazio, sobre separar el reclamo de las personas detenidas en el marco de la Ley de Drogas 23737, del avance de la industria, desató el repudio de las organizaciones sobre todo en redes sociales.

    “Nosotras no entendemos, ni concebimos esta esquizofrenia legislativa en la que todos deciden vivir sin decir nada, porque realmente hay que entender que esto ya no va más. Que exista la justicia social que tanto proponemos, porque no puede ser que estamos discutiendo importar semillas, y a nadie le importa la gente que está en ´cana´”, expresó Soledad Pedrana, presidenta de la ONG Plan Verde.

    En tanto Aguirre, sostuvo el reclamo de una línea de reparación histórica para los presxs por plantar: “Hay muchas experiencias a nivel internacional, como licencias especiales para damnificados, bajos precios y exenciones, entre otros. Hoy ya lo está haciendo Washington”.

    “Ninguna industria propia va a crecer bajo la sombra de los presxs, porque eso no va a pasar, eso es equilibrio, es justicia social y eso va a tener que entenderse”, puntualizó Soledad Pedrana.

    Las organizaciones dijeron presente en la Primer Expo Cáñamo Argentina, participando de la mesa de debate legislativo, junto a Laura Villamayor, abogada del INASE y Dante Boglieri, abogado del ministerio de Desarrollo de San Luis.

    Las representantes de la Federación, ven en la nueva industria cañamera la posibilidad de avanzar en la formación de una cooperativa semillera para trabajar en la figura del fitomejoramiento, registrar variedades y armar pequeños nodos productivos.

    “En relación al cáñamo, al movimiento cannábico no lo sorprende. Desde AUPAC estamos acompañando un proyecto de San Luis que se acaba de presentar  que incluye cáñamo, biodisel, barritas de cereales. Es el mismo cultivador que va a cultivar en nuestro cultivo asociativo. El movimiento también es ecologista y el cáñamo es un aliado en la fitoremediación del suelo” contó Pedrana.

    Problemas con el REPROCANN

    En marzo de este año el Ministerio de Salud, anunciaba que el Registro del Programa de Cannabis iba a tener la categoría para que ONGs puedan inscribir a pacientes y declarar sus cultivos solidarios. Hasta el momento esa disposición no fue puesta en marcha por problemas de software manifestados desde el propio ministerio.

    “No se puede avanzar cuando todavía no tenemos un marco jurídico que nos ampare, seguimos siendo ilegales. No es justo. Ya de por sí tenemos un límite de 150 pacientes por organización que es bajísimo para nuestra realidad.”, expresó Pedrana, representante de AUPAC. Asimismo destacan al labor del Ministerio de Salud de incluir una cláusula para poder pedir una extensión del límite en caso de requerirlo.

    “Necesitamos un acompañamiento en las figuras jurídicas. En estos años de transición con intereses y tensiones para ver cómo se iba a resolver las autorizaciones, muchas organizaciones fueron vapuleadas por el Estado en sus estructuras para poder sacar sus personerías. Pero si te fijas ves que las empresas no tienen estos inconvenientes”, respondió Aguirre, futura presidenta de la Federación Cannábica Argentina.

    Mientras tanto el acceso, el abastecimiento y la realidad de la demanda de cannabis medicinal hoy lo sigue soportando el territorio. En la actualidad AUPAC se hace cargo de aproximadamente 1000 paciente con un gasto mensual de 60 mil pesos en cromatografías. En una misma provincia, Santa Fe, donde actores como LIF, Laboratorio de la provincia, comienzan a montar cultivos para posicionarse en el mercado del cannabis medicinal, junto al apoyo de la gobernación. Misma Gobernación que trabaja con AUPAC en concretar un Consejo Asesor que pueda brindar ayuda en el camino legislativo y el Estado cooperar con la organización.

    Las organizaciones entienden que la situación actual de la industria del cannabis gira entorno a que «los privados están ocupadísimos en querer entrar al mercado y que el único monopolio es el Estado». Desde esta óptica las organizaciones consideran que están siendo supeditadas a la fuerza de intereses entre ellos.

    La labor de la Federación será continuar luchando para descentralizando el poder y la economía: “Todavía no se entendió que la ONG sin fines de lucro era la única manera de sentirnos protegidas en la ´nada´. Que se piensan que la organización no quiere producir, no quiere ganar plata”, enfatizó Soledad Pedrana.

    “Aparte hay un reconocimiento en la ley donde nos da la posibilidad de convertirnos en unidades productivas y eso vale recordar que no estaba en la redacción aún siendo nostras parte del Consejo Consultivo Honorario. Cuando el Ministerio de Producción redactó la ley, se olvidó de los pequeños productores”, agregó Roxana Aguirre.

    «Como Federación nuestra labor es arrojar luz a cada rincón del país, y que no quede todo en algunas manos del Consejo Consultivo Honorario. Sabemos que hay muchas ´organizaciones´ nuevas que hacen estudios de mercados para ver si les conviene esa categoría o se cooperativa, o empresa”, comentó Pedrana.

    Y agregó para cerrar: “Tienen derecho a hacerlo y a insertarse en la industria. Lo que no hay derecho es que el Estado pise la memoria de donde nace la industria. La industria no empezó ni en Kulfas (ex Ministro de Producción), ni en Fazio (Presidente de Argencann). Solo hay grandes actores acomodándose. Entrar vamos a entrar todos, porque el equilibrio es divino».

    Las representantes de la Federación adelantaron que exigirán un lugar en el Consejo Asesor de la nueva Ley de Industrias 27669, de la cual ya comenzó a redactarse el borrador de la reglamentación y las organizaciones esperan poder participar.
