    El gobierno presentó el proyecto de ley para la producción del cannabis y el cáñamo industrial

    El gobierno finalmente presentó el proyecto de ley para dar un marco regulatorio al desarrollo de la industria del cannabis medicinal y del cáñamo industrial. Se dió a conocer en el encuentro del Consejo Económico y Social, y fue girado al Congreso para su respectivo tratamiento.

    Esta tarde en el Museo de Bicentenario, ante la presencia de consejeros, académicos, legisladores, referentes del sector y gobernadores, el ministro de Desarrollo Productivo, Matias Kulfas, anunció la iniciativa para regular industria del cannabis y sus derivados con fines medicinales, terapéutico o paliativo y el cáñamo y/u hortícola de uso industrial.

    El cannabis medicinal aventaja unos meses en la producción de aceite por el autocultivo, la compra en farmacias o importación por la regulación de la ley 27.350, pero este proyecto apunta a desarrollar toda la cadena de procesos, que según la Cámara Argentina de Cannabis (ArgenCann) en Argentina hay alrededor de 15 millones de usuarios potenciales de cannabis medicinal y proyecta una exportación mensual de 60 millones de dólares.

    Aún más novedoso es que se retomará la industrialización de cáñamo para uso alimenticio, higiene, textil, partes y repuesto de automotores, bio-combustibles, y sobre todo como alternativa para el reemplazo del plástico. Producción que cesó durante la dictadura del ´78 y estaba vigente desde los escritos de desarrollo económico de Manuel Belgrano.

    Participaron del anuncio la ministra de Salud de la Nación, Carla Vizzotti; el ministro de Ciencia, Tecnología e Innovación de la Nación, Roberto Salvarezza; y el de Agricultura, Ganadería y Pesca, Luis Basterra. Estos ministerios, junto a Desarrollo Productivo y Seguridad, compondrán el directorio de Agencia Regulatoria de la Industria del Cáñamo y del Cannabis Medicinal (ARICCAME).

    Además se hicieron presente, de manera virtual, el gobernador de La Rioja, Ricardo Quintela; el gobernador de Jujuy, Gerardo Morales; las diputadas nacionales Mara Brawer y Carolina Gaillard; el senador de la Nación por Chubut Alfredo Luenzo; el embajador en Israel Sergio Urribarri; el director del IIEP CONICET, Andrés López; y el presidente de la Cámara Argentina de Cannabis, Pablo Fazio.

    LA AGENCIA

    El proyecto propone una fuerte presencia estatal en el mercado, mediante la creación de la ARICCAME, que centralizará de forma nacional todos los procesos desde la inscripción para obtener la licencia hasta la exportación de productos. Tendrá autarquía nacional y dependerá de la Jefatura de Gabinete, que por designación del Poder Ejecutivo, se compondrá de cinco miembros con rango de Secretaría.

    Tendrá como función regular y reglamentar la importación, exportación, cultivo, producción industrial, fabricación, comercialización y adquisición, por cualquier título de semillas de la planta de cannabis, del cannabis y de sus productos derivados con fines medicinales o industriales. Con respecto a las semillas, el Instituto Nacional de Semillas (INASE), regulará la trazabilidad de los productos vegetales y en coordinación con la ARRICCAME, dará lugar al registro de nuevas especies con derecho de autoría.

    PYMES Y PEQUEÑOS PRODUCTORES

    Sobre un contexto de crisis social y económica, el proyecto buscará dar prioridad a economías regionales, cooperativas y pequeñas y medianas empresas –donde también podrían incluirse los grow shops que ya comercializan estos productoras- atendiendo sus solicitudes principalmente, apoyo técnico y disminución de tasas, pero «asimismo la inclusión de la perspectiva de género y diversidad en su otorgamiento», así se desprende del proyecto. Para este fin, se trabajará en conjunto con el Instituto Nacional de Asociativismo y Economía Social (I.N.A.E.S).

    Además la reglamentación prevé un programa especial destinado a los emprendimientos de las ONG de la sociedad civil que han desarrollado saberes, conocimientos y por experiencias propias y militancia acerca de los diversos usos medicinales, terapéuticos y paliativos de la planta del cannabis.

    Al momento la oposición no ha emitido posición sobre dar los votos al proyecto pero pareciera haber cierto consenso en off. De aprobarse y convertirse en ley, el Poder Ejecutivo tendrá 180 días hábiles para su reglamentación, donde tendrá que limitar los niveles de THC para definir ante la norma al cannabis psicoactivo y el cáñamo, dato no menor ya que dejará excluido a este último de la ley de drogas 23.737
