El foco está puesto en la despenalización del consumo personal de estupefacientes, amparado en el Fallo Arriola de la Corte Suprema año 2009 indicando que el artículo 14 –de la Ley de Drogas-, que reprime la tenencia de estupefacientes para consumo personal, es incompatible con el principio de reserva contenido en el artículo 19 de la Constitución Nacional que protege las acciones privadas que de ningún modo ofendan al orden y a la moral pública, ni perjudiquen a un tercero.
“Esperemos que lo qué pasó sirva para impulsar el debate y que no sigamos postergando una discusión necesaria y urgente como es la modificación de la Ley de Drogas”, expresó Gaillard a este medio. El pedido de la diputada va en consonancia con las declaraciones de los ministros de Seguridad, tanto de Nación como PBA, admitiendo que la famosa “Guerra contra las drogas” fracasó.
Para el caso del cannabis- para todos sus fines- el proyecto establece que el consumo personal quedaría fijado en los límites, que hoy tiene el REPROCANN con fin medicinal, de 40grs de flores y 9 plantas. Fuera de este parámetro, que agregaría además la posibilidad de tener semillas, resinas y derivados, la pena fuera del uso personal será de 2 a 6 años de prisión.
Para el autocultivo, para sí o para terceros inscriptitos en el REPROCANN, el proyecto extrema los requisitos por los cuales un juez podría llegar a emitir una orden de allanamiento o las fuerzas de seguridad demoran a usuarios en la vía pública -sospechando fines comerciales-. Hechos que en la actualidad se repiten a diario. “Deberán abstenerse el poder judicial y las fuerzas de seguridad de iniciar causas, detener y decomisar cultivos. Y en el caso de presunción de otros delitos, se deberán extremar los cuidados para que el procedimiento preserve los cultivos sin alterarlos”, indica su redacción.
Además se busca instruir a jueces y fiscales, fuerzas de seguridad, en el orden nacional, provincial y municipal sobre los principios de no discriminación, no persecución y no criminalización, a los usuarios de cannabis y sea entendido como un derecho humano a la salud. La falta de licencia para el autocultivo por sí misma no deberá ser interpretada como delito de comercialización. Y por último sobre cannabis, agrega que previo a una medida de coerción, como el caso de un allanamiento, se deberá revisar registros del REPROCANN, para conocer si la persona está vinculada, certificar en ANSES que la persona no tenga certificado de discapacidad y reconocer circunstancias de vulnerabilidad de género y pobreza como atenuantes de responsabilidad, sobre todo en la población de mujeres y personas trans.
El proyecto impulsado por Carolina Gaillard que acompaña con las firmas de: Mónica Macha, Blanca Osuna, Verónica Caliva, María Rosa Martínez, Carolina Yutrovic, Jimena López, Itaí Hagman, Mabel Caparrós, Lucila Masin y Mara Brawer, ya tiene estado parlamentario por lo que puede tratarse a partir de marzo 2022 en sesiones ordinarias.
