    Piden importar aceite de cannabis para tratar caso de epilepsia refractaria

    Durante la jornada del martes 14 de septiembre, la Cámara en lo Contencioso Administrativo Federal ordenó a la Administración Nacional de Medicamentos, Alimentos y Tecnología (ANMAT) que, con el fin de poder realizar el tratamiento de una menor de edad con que padece epilepsia refractaria, se autorice la importación de un aceite específico.

    Este aceite cannábico necesario de importar es un medicamento identificado como “Aceite de Cannabis Real Scientific Hemp Oil Max 10” de 10.000 miligramos de CBD en 236 ml, y, según lo resuelto por la Sala II de la Cámara en lo Contencioso Administrativo Federal, en los próximos cinco días deben realizarse todos los actos necesarios para su “inmediata” importación.

    Un punto clave para la resolución de la orden de la Cámara, fue el señalamiento en la demanda de la madre de la niña discapacitada de la creación del Programa Nacional para el Estudio y la Investigación del Uso Medicinal de la Planta de Cannabis, sus Derivados y Tratamientos No Convencionales, correspondiente a la órbita del Ministerio de Salud de la Nación, surgida de la ley 27.350 y de su decreto reglamentario.

    Como lo indica uno de los artículos de la mencionada ley, más precisamente el artículo 7, la ANMAT, en los casos en los que un paciente presenten patologías que se correspondan con las estipuladas en el programa del Ministerio de Salud de la Nación, permitirá la importación de aceite de cannabis y de sus derivados.

    Cabe señalar que antes de la orden de la Cámara, anteriormente, en primera instancia, la medida cautelar había sido rechazada con el argumento de que, para tratar esta patología de la menor, existe otro medicamento identificado como “Convupididol”, pero en la demanda se especificó que la menor de 13 años padece convulsiones al síndrome de Dravet o Lennox-Gastaut, es decir, un cuadro diverso.

    En ese sentido, en base a lo resuelto por la Sala II de la Cámara, se llegó a la conclusión de que “no aparece en principio ajustado que se prohíba a la paciente recibir un medicamento específicamente indicado para el tratamiento de su afección” con el argumento de que en el mercado local “existe otro producto, que según su propio fabricante, es de aplicación a un padecimiento diferente”.

    Es por eso que, haciendo hincapié en la urgencia de atender rápidamente las afecciones que la epilepsia refractaria y sus respectivas manifestaciones causan a la menor de edad, los camaristas José López, María Caputi y Luiz Marquéz, para evitar cualquier riesgo que pueda generar la demora en la adquisición del medicamento, justificaron la medida provisoria.
