    El gobierno reglamentó el registro de cultivadores medicinales

    La medida fue anunciada este viernes en el Boletín Oficial (BO) por medio de la resolución 800/2021. Para poder registrarse, las personas deberán contar con la indicación de un profesional de la salud. 

    A 4 meses de haber legalizado el autocultivo de cannabis con fines medicinales, el gobierno reglamentó el registro de cultivadoras y cultivadores en donde tendrán que anotarse para obtener la autorización correspondiente que les permita tener las plantas en su domicilio. 

    La resolución, que lleva la firma de la ministra de Salud, Carla Vizzotti, establece un control sobre las usuarias y usuarios que quieran acceder a la planta de cannabis y sus derivados como alternativa medicinal, terapéutica y/o paliativa del dolor, a través del cultivo controlado. 

    En este sentido, se aprobó la creación del Sistema de Registro del Programa de Cannabis (REPROCANN), en donde deberán inscribirse por sí mismos o por medio de un representante para obtener la autorización de cultivo personal o para acceder al cultivo a través de una tercera persona (cultivador) o por medio de una organización civil que esté habilitada. 

    La inscripción al registro se hará a través de la página oficial del REPROCANN y el acceso se solicitará mediante la plataforma de MI Argentina. Todos los datos que se ingresen en la plataforma tendrán “carácter de declaración jurada”, es decir que si se detecta algún error o falsedad en los datos cargados se podrá revocar la autorización de cultivo otorgada. Una vez aceptada la solicitud, el sistema enviará un certificado que será la prueba fehaciente y autosuficiente del cumplimiento de las condiciones establecidas por las autoridades y la cual tendrá un “plazo de vigencia de 1 año desde la fecha de emisión”.

    Además, será un requisito excluyente, para quienes quieran hacer la solicitud, contar “con indicación médica de uso de cannabis y sus derivados por parte de un profesional médico” y que a su vez éste dé su “Consentimiento Informado Bilateral” detallando beneficios y riesgos del tratamiento y las consecuencias en caso de no aceptarlo. 

    Por otro lado, el texto aclara que los cultivadores que registren su autocultivo en el ministerio de Salud no podrán usar las genéticas nativas que utilizan en la actualidad. En ese sentido, indica que “el germoplasma que no haya sido ingresado o declarado con origen genérico ante el INASE no podrán solicitar inscripciones ante los distintos registros de dicho organismo”. 

    En la resolución el gobierno señaló también que “hay que tener en cuenta el manejo del cultivo y las condiciones en las que se lleva a cabo”. Por esa razón, estableció que las personas registradas en el REPROCANN podrán tener hasta 9 plantas en floración, fijó los cultivos en un máximo de 6 metros cuadrados y el transporte de hasta 6 frascos de 30ml o 40 gramos de flores secas. Además, se va a permitir el cultivo en interior, mientras que el cultivo en exterior seguirá prohibido.
