    Mar del Plata: Fallo judicial para evitar detenciones

    A un año de un habeas corpus preventivo presentado por la Agrupación Marplatense Cannabicultores (AMC) para evitar detenciones de usuarias y usuarios en la vía pública, en el contexto de un nuevo “Operativo de Sol a Sol” por la temporada de verano en la costa, la Justicia de Garantías dió lugar al recurso presentado y le ordenó a todas las fuerzas de seguridad que operan en Mar del Plata no realizar detenciones ni traslados a comisarías de personas a las que se encontrase con pequeñas cantidades de drogas para consumo personal.

    El fallo del juez de Garantías, Juan Tapía, ordenó a las fuerzas que “se abstengan de realizar la detención, en espacios públicos, de usuaries de sustancias que la ley define como estupefacientes, cuando las circunstancias del caso pongan de manifiesto que la tenencia es para consumo personal y la conducta se realice en condiciones tales que no traiga aparejado un peligro concreto o un daño a derechos o bienes de terceros”.

    Además, instó a los efectivos a que en procedimientos en los que haya personas intoxicadas por consumo de sustancias psicoactivas se apliquen “las normas y principios imperantes en la Ley Nacional de Salud Mental 26.657 y las pautas que regula el Plan Integral para el Abordaje de los Consumos Problemáticos”.

    Por último, el juez Tapía fijó un límite para que los efectivos sepan cuándo se entiende que la tenencia es para consumo personal. De esta forma, los uniformados no podrán detener ni trasladar a comisarías a personas que tengan consigo un máximo de 50 gramos de cannabis, 10 gramos de cocaína y 3 pastillas de éxtasis.
