    Alemania legaliza el cannabis: solo para adultos y limitado a tres plantas por persona

    El Gobierno alemán toma la decisión con la opinión en contra de la asociación médica alemana.

    En los últimos meses, desde que el ministro alemán de Sanidad Karl Lauterbach anunció sus intenciones, proliferan en la prensa alemana las viñetas en las que se presenta a los miembros de la coalición semáforo, en la que el socialdemócrata Olaf Scholz gobierna con liberales y verdes, fumados y felices. 

    La gran resistencia que el proyecto ha despertado entre asociaciones de padres, médicos y organizaciones de lucha contra la drogadicción apenas han servido para suavizar el borrador y el gabinete de ministros ha dado este miércoles el primer paso hacia la legalización del cannabis.

    “Se trata de un concepto de legalización controlada”, ha dicho Karl Lauterbach, en virtud del cual se permite a los mayores de 18 años la posesión de hasta 25 gramos y el cultivo de hasta tres plantas de marihuana, de forma limitada. 

    Lauterbach ha presumido que la nueva ley cambiar el rumbo de la política de drogas alemana ha defendido que “los productos en el mercado negro son más peligrosos a causa de las mezclas”.

    No habrá venta libre

    “Es una ley con sentido de la proporción”, ha descrito el ministro. La ley establece también que en las asociaciones de cultivo los alemanes adultos puedan reunirse para producir cannabis en condiciones controladas. Los miembros pueden obtener en estas organizaciones hasta 50 gramos por mes. 

    La posesión y el consumo siguen prohibidos para los menores, a los que la ley establece que se destinarán campañas informativas que aclaren que “si consumes cannabis en grandes cantidades o lo haces habitualmente, estarás causando daños a tu cerebro, en esto hay que ser muy claros”, ha dicho Lauterbach, en referencia a las personas menores de 25 años.

    Tras este anuncio, la ley será debatida en el Bundestag y el Bundesrat, para ser aprobada antes de finales de año y comenzar a ser aplicada inicialmente en determinadas regiones piloto, no en todo el país al mismo tiempo como preveía el primer borrador.

    La ley es muy específica respecto a la comercialización de la droga. No habrá una venta libre del producto en las tiendas y cada asociación o club de consumo y cultivo podrá aceptar un máximo de 500 miembros, todos los cuales deben ser mayores de edad y tener su domicilio o residencia habitual en Alemania. 

    Solo alguien cuya “fiabilidad haya sido comprobada”, podrá dirigir un club, en cuyas instalaciones estará prohibido el consumo, así como en las inmediaciones de colegios, guarderías y zonas peatonales durante el día.

    El gobierno alemán se reserva el derecho de limitar el número de clubes, por ejemplo, en función de la densidad de población. Estará prohibida la afiliación a varios clubes para que no se excedan los límites del consumo y los menores de 21 años sólo podrán obtener un máximo de 30 gramos por mes. En la producción de la droga, además, queda limitado el contenido del ingrediente activo THC, aunque la cantidad exacta aún no ha sido determinada.

    Clubes sociales de consumo

    Adelantándose al gabinete de ministros, en varios estados federados la gente ya se ha unido para formar los llamados Clubes Sociales de Cannabis. Existe una asociación en Turingia con 250 interesados, que pronto se registrará en Weimar. 

    Según el portavoz Friedemann Söffing, “es previsible que en breve haya al menos un club así en todas las grandes ciudades”. Un club de Erfurt, ya tiene 80 registros.

    En Stuttgart, Baden-Württemberg, también existe ya una primera asociación de cannabis que, según su presidente Julen Merino, cuenta con casi 470 miembros. 

    “Nos hemos visto abrumados con las solicitudes de membresía”, dice Merino, “hemos decidido no aceptar más miembros nuevos por ahora para no vernos desbordados”.

    Los médicos, en contra

    El Gobierno alemán toma esta decisión en contra de la Asociación Médica Alemana, cuyo presidente, Klaus Reinhardt, ha advertido “especialmente para los adolescentes y jóvenes se ha demostrado que el cannabis es un problema grave y dañino” y que “la legalización no detendrá el comercio ilegal de la droga, como sucede en Canadá, donde la venta de cannabis ya es parcialmente legal pero el 40 por ciento todavía se trafica ilegalmente”.
