    Firmas para la derogación de la Ley de Drogas: A 14 años del fallo Arriola continúa la persecución por tenencia para consumo personal.

    En el petitorio de reclamo también se pide por la plena implementación de las leyes de cannabis medicinal.

    A 14 años del fallo Arriola y 37 de Bazterrica, que sentaron precedente sobre la tenencia de cannabis y otras sustancias en Argentina, diferentes sectores del ambiente cannábico piden la derogación de la ley de drogas (23737) mediante la junta de firmas en un form online, así como la plena vigencia de las actuales ley de cannabis medicinal (27350) y de la industria de la planta (27669) en el país.

    El escrito difundido plantea que “el actual abordaje y las prácticas estatales en materia de seguridad y narcomenudeo nos debe llevar a un debate serio respecto a cómo pensamos las intervenciones y operativos de las fuerzas de seguridad”. 

    De esta manera se propone derogar o, al menos, modificar la ley de estupefacientes 23737 en lo que refiere a las figuras de tenencia. “A 14 años del fallo Arriola y a 37 del fallo «Bazterrica», resulta indispensable, al menos fijar un horizonte entorno a qué se persigue penalmente hablando, cómo se lo hace, cuáles son las metas a alcanzar en política de drogas y tener en cuenta las actuales normativas en materia de Cannabis Sativa L”, detalla el petitorio.

    Entre quienes apoyan el petitorio se encuentran: Usuarios y usuarias, Asociaciones, Cooperativas, Federaciones, Proyectos de Investigación y/o Salud, Empresarios, empresarias y Empresas, Grows, Distribuidoras, Breeders, Investigadores e investigadoras, Profesionales de la salud, Veterinarios, Microemprendedores y microemprendedoras, Organismos Gubernamentales y Movimientos.

    Exigencias al Poder Legislativo, Ejecutivo y Judicial de la Nación:

    • Que se libere de manera inmediata a todas las personas presas por usar, cultivar Cannabis ,y/o producir derivados, cuando sean las mismas cantidades que hoy están permitidas por la ley 27350 o las Resoluciones del INASE, mediante la figura del Indulto, regulado en el artículo 99, inciso 5 de la Constitución Nacional, que establece que “el Presidente de la Nación puede indultar o conmutar las penas por delitos sujetos a la jurisdicción federal”. En la actualidad existen normativas y resoluciones que permiten estas conductas, por lo tanto en esta vulneración de los derechos adquiridos, transitamos un “principio de contradicción”.
    • Que se derogue la ley de drogas 23.737. La vigencia del discurso de la “guerra contra las drogas” no logró resolver ninguno de los problemas que se proponía solucionar. Por el contrario, incrementó todos los daños que no son propios de las drogas sino de la prohibición; produjo corrupción política, judicial y de las fuerzas de seguridad, persiguió y encarceló a vastos sectores sociales, produjo guerras territoriales entre bandas y derrochó infinidad de recursos económicos que deberían utilizarse para fortalecer el sistema sociosanitario. 
    • Que en el abordaje estatal en materia de seguridad y narcomenudeo se consideren las actuales normativas de la ley 27.350, las resoluciones del INASE y la ley 27669.
    • Que de forma perentoria se retire al Cannabis y las resinas de Cannabis del “listado de estupefacientes”, tal como recomendó en 2020 la Comisión de Estupefacientes de Naciones Unidas.
    • Que se aplique el artículo 16 de la Constitución Nacional que refiere que todos/as sus habitantes “son iguales ante la ley, y admisibles en los empleos sin otra condición que la idoneidad”.
    • Que se actualicen, promuevan y fomenten en todo el territorio argentino, las capacitaciones a las fuerzas de seguridad y Poder Judicial, Federales y Provinciales, en materia de la ley 27.350 de Cannabis Medicinal y su programa Reprocann y la ley 27.669 de Cannabis Medicinal y Cáñamo Industrial.

    Fallo Bazterrica

    El 29 de agosto de 1986, la Corte Suprema de Justicia de la Nación declaró la inconstitucionalidad de la persecución del delito de tenencia de estupefacientes para consumo personal.

    Sucedió en el marco de la causa contra el músico Gustavo Bazterrica, a quien la Sala IV de la Cámara Nacional de Apelaciones en lo Criminal y Correccional condenó a la pena de un año de prisión en suspenso y multa, por considerarlo autor del delito de tenencia de estupefacientes en los términos del artículo 6° -hoy derogado- de la Ley 20.771. De esta manera, la Cámara confirmó la sentencia dictada en primera instancia.

    Contra tal pronunciamiento el imputado dedujo recurso extraordinario, sosteniendo que la norma violaba la garantía constitucional establecida en la primera parte del art. 19, de la Constitución Nacional, especialmente en atención a la pequeña cantidad de sustancia hallada en poder del procesado (3,6 grs. de marihuana y 0,06 grs. de clorhidrato de cocaína).

    El 25 de agosto del año 2009 la Suprema Corte de Justicia declaró inconstitucional al segundo párrafo del artículo 14 de la Ley de Estupefacientes (23737), de la penalización de la tenencia para consumo personal, en tanto y en cuanto esa tenencia personal no afecte a terceros.
