    Como cada año la Marcha Mundial de la Marihuana volvió a expresar su reclamo en la calle

    A 40 años de la vuelta a la democracia continúa la deuda con la comunidad cannábica en la reforma de la Ley de Drogas 23.737.

    Otro primer sábado de mayo en que se celebra la Marcha Mundial de la Marihuana (MMM), edición número 14, en donde las banderas vuelven a salir para encolumnar a la comunidad cannábica que se reencuentra en su balance anual.

    Organizaciones, emprendedores, y productores hoy presentes en la MMM, que posiblemente hayan logrado algún avance en sus proyectos cannábicos, se suman al reclamo democrático de la comunidad que prevalece en el frente desde la primer convocatoria “No más presxs por cultivar”.

    “La prohibición viola el derecho constitucional de la privacidad de las personas invocado en el Art.19 de la Constitución Nacional, el derecho al desarrollo de la libre personalidad, salud y cultura entre otros que forman parte de los Derechos Humanos fundamentales”, expresó el comunicado consensuado entre las organizaciones.

    Argentina carece de un modelo consistente en el tiempo para abordar la “problemática de las drogas ilícitas”. Al sistema legal punitivo, el crecimiento de la población carcelaria y las prácticas represivas a cargo de las diferentes fuerzas de seguridad, se contrapone la jurisprudencia garantista de la Corte Suprema (no siempre presente) y la defensa de los Derechos Humanos. El Estado nacional mantiene el doble estandarte promoviendo derechos individuales básicos y el acceso a servicios públicos como la salud y, por el otro, ha recaído con todo el peso de la ley sobre los sectores más vulnerables de la cadena del narcotráfico.

    La 14°edición de la MMM  rescata el reclamo de colectivos emergentes que sufren la persecución policial por estigmatización: «El prohibicionismo es sinónimo de machismo. Tanto las mujeres como la comunidad LGBT+ sufren la persecución encarnizada por las fuerzas de seguridad”, reclamaron en el documento consensuado.

    Está claro que la famosa “Guerra contra las drogas” iniciada por Harry Anslinger, en la vieja Oficina Federal de Narcóticos, y profundizada por Richard Nixón en los años ´70 fracasó, pero el giro de los Estados Unidos y la Organización Mundial de la Salud (OMS) a la apertura del cannabis medicinal, plantea un nuevo frente: los laboratorios.

    Los avances en la legislación de enfoque medicinal como la Ley 27.350 (2017), reformulada su reglamentación en 2020, que dio origen al REPROCANN –Registro de usuarios para el autocultivo con fines medicinales- también es foco de deudas en su articulación. Aún no se cumple en el sistema público de salud, obras sociales y prepagas la prestación de que los afiliados y pacientes puedan acceder al aceite de cannabis de forma gratuita. Tampoco se ha incorporado en el vademécum –listado de referencia sobre preparados medicinales- los fitopreparados  derivados del cannabis para que por ejemplo adultos mayores puedan acceder a través de PAMI.

    Por parte de las cooperativas y ONGs, recibieron en las últimas semanas la habilitación de la opción –vía web- para inscribirse en el REPROCANN como tal y poder abastecer hasta 150 pacientes, pero aún se desconoce los términos en que serán aprobadas.

    La Ley de Producción 27.669 que dará inicio a la cadena de usos, producción y comercialización del cannabis medicinal y cáñamo industrial cumplió un año, periodo en el cual se puso en marcha la Agencia del Cannabis (ARICCAME),  sobre la cual el sector privado y las sociedades del estado aún esperan las licencias para poder comenzar a comerciar y recuperar la inversión.

    En el caso de las cooperativas, continúa el reclamo sobre el Instituto Nacional de Asociativismo y Economía Social (INAES) para definir la normativa que regule a estas entidades con un objeto cannábico, figura aún inexistente en el organismo, y les permita acceder a fuentes de financiamiento y beneficios.

    Es este marco la comunidad cannábica convive con una Ley de Drogas vigente desde 1989 que aumentó la pena de prisión por narcotráfico en 4 y 15 años y transformó la posesión para consumo personal en un delito penado con prisión. Específicamente, en el caso de pequeñas cantidades de posesión de marihuana, el párrafo segundo del art.14 estipula que la pena oscilará de entre un mes y dos años de prisión, dejando a merced del fiscal y juez la determinación de qué cantidades se consideran consumo personal.

    Así desde el año 2010 la MMM aumenta en adhesiones y asistencia de público, por suerte cada año se refleja más jóvenes, para reclamar esta política represiva sobre los usuarios responsables, al mismo tiempo que las estadísticas por incautación de plantas de cannabis aumenta según informes del Ministerio de Seguridad: recién en 2011 la cantidad de plantas incautadas superaban las 5000, pero en 2016 esta cifra alcanzó las 72.776 y continúo en aumento.
