    El uso recreativo de la marihuana se aprobó en dos de los cinco estados que lo sometieron a consulta en las elecciones de EEUU

    Con la aprobación en Maryland y Missouri, este tipo de consumo del cannabis será legal en 21 de los 50 territorios de los Estados Unidos

    Cinco estados de Estados Unidos consultaron a sus votantes por el uso recreativo de la marihuana en estas elecciones de medio mandato y sólo en dos de ellos, Maryland y Missouri, apoyaron su legalización.

    La consulta obtuvo, por el contrario, un resultado negativo en Arkansas, Dakota del Norte y Dakota del Sur, donde se impuso el “no”.

    En los cinco estados ya estaba permitido el uso medicinal de la marihuana y sólo en Maryland y Missouri los votantes han apostado por dar un paso más y apoyar el recreativo.

    Con estos dos territorios son ya veintiuno los estados que tienen legalizada esta droga para fines recreativos.

    En Dakota del Norte, los votantes ya rechazaron en 2018 la legalización completa del cannabis y en su hermano del Sur ya se aprobó una medida similar en 2020 que fue anulada por la Justicia del estado.

    La despenalización del consumo de marihuana es una de las grandes apuestas del Partido Demócrata a nivel nacional pero, aunque a nivel local también hay representantes republicanos que la apoyan, la mayoría de los conservadores de la Cámara Baja se han opuesto a la medida, lo que ha impedido a los progresistas implementarla.

    La medida de Missouri legalizará la marihuana recreativa para los adultos mayores de 21 años y borrará los registros de arrestos y condenas anteriores por delitos no violentos relacionados con la marihuana, excepto por la venta a menores o la conducción bajo la influencia.

    “Esto demuestra que no se trata de una cuestión partidista”, dijo John Payne, que dirigió la campaña de Missouri para legalizar el consumo de marihuana. “Esto es algo que trasciende las divisiones partidistas”. También dijo que esperaba que las ventas recreativas comenzaran en Missouri a principios del próximo año.

    Los opositores dijeron que estarían trabajando para limitar la implementación de la legalización de Missouri, como trabajar con las ciudades y pueblos para optar por no permitir los dispensarios. “El diablo está en los detalles, y seguiremos participando activamente en la implementación de Missouri porque no necesitamos otra industria de las grandes tabacaleras que dañe a los niños en Missouri”, dijo Kevin Sabet, presidente de SAM Action, un grupo antilegalización.

    La falta de progreso en este ámbito llevó al presidente estadounidense, Joe Biden, a anunciar el pasado mes una serie de órdenes ejecutivas para avanzar en la despenalización del consumo de cannabis. Entre ellas, Biden perdonó el pasado octubre a todos los condenados a nivel federal por posesión de marihuana y animó a las administraciones estatales a hacer lo propio a nivel estatal. También ordenó a los Departamentos de Salud y de Justicia comenzar el proceso para revisar la clasificación del cannabis en la lista de sustancias controladas del país.

    Actualmente ocupa el nivel 1 junto a drogas como la heroína o el LSD, el más restrictivo.

    Pese a su clasificación a nivel nacional, el consumo recreativo de marihuana es legal en 19 estados y en la capital del país, Washington, mientras que su uso por motivos médicos está contemplado en 37 estados y en la propia capital.
