    Colombia: regulan el uso industrial del cannabis para alimentos, bebidas y textiles

    El gobierno colombiano publicó la resolución 227 de 2022 que reglamenta el uso industrial del cannabis no psicoactivo. El proceso para su exportación se inició el año pasado con el decreto 811 de 2021.

    Según explica el Ministerio de Salud, el decreto define los protocolos y mecanismo para la exportación de la flor seca de cannabis, como así también los usos industriales de la misma.  Por su parte, la reciente resolución permite y establece “todos los mecanismos y procedimientos para el uso industrial del cannabis en sectores como alimentos, bebidas y también usos textiles”, definiendo así que estos usos tienen que ver con el componente “no psicoactivo” (Cáñamo).

    El presidente Ivan Duque remarcó que en el plazo de un mes debe finalizar la reglamentación de cupos y tarifas, que permitan abastecer la demanda del mercado nacional e internacional de productos de cáñamo.

    “Ya se ha avanzado en los créditos para pequeños y medianos productores, esos créditos a través del Banco Agrario siguen desarrollándose, donde también se les facilita a los productores de cannabis todos los temas de manejo de divisas, monetización y comercialización desde Colombia”, señaló el mandatario. 

    Por otro lado, el ministro de Salud, Fernando Ruiz Gomez , comentó que esta reglamentación es importante para el desarrollo seguro de la industria y las actuaciones de los diferentes actores del sector. Además, resaltó la importancia de las diferentes disposiciones sanitarias que deben tener lugar por parte del Instituto Nacional de Vigilancia de Medicamentos y Alimentos (INVIMA) , “con buenas prácticas de manufactura, y todos los requerimientos de etiquetado y envase, son fundamentales para todo el avance de la industria”.

    ¿Cómo se solicitan las licencias?

    Según explicó el Ministerio de Salud, para solicitar las licencias los trámites se harán mediante el Mecanismo de Información para el Control de Cannabis (MICC). Por otro lado, para pedir la extensión de la licencia, para aquellas personas que se les fue otorgada por cinco años por el Decreto 613 de 2017, tendrán que presentar el pago correspondiente y hacerlo como mínimo tres meses antes del vencimiento.

    Desde la Cartera confirmaron que ya se puede pedir o modificar la licencia de cultivo en la modalidad exportación, para eso deberán cumplir con 2 requisitos: 

    – Indicación del material que se pretende exportar. 

    – Indicación de los potenciales países hacia los cuales se pretende exportar el material, y que permita la importación para uso médico y científico.

    Según explicaron desde el Ministerio, las personas que no tienen licencias y están interesadas los requisitos son los mismos y podrán incluir a un tercero. “Las actividades que se podrán tercerizar son el cultivo, cosecha y postcosecha; la transformación de grano; el almacenamiento de semillas, grano, componente vegetal, plantas de cannabis, cannabis y derivados de cannabis; y la fabricación de derivados. Las demás actividades deberán ser informadas como novedad”, aclararon desde la Cartera. 

    También se podrán realizar publicidades de los componentes de las plantas de cannabis y sus derivados como así también de productos que contengan sus componentes. 

    Por su parte, quienes quieran seguir realizando actividades de fabricación de cáñamo industrial, desde el ministerio aclararon que tendrán un plazo de seis meses para radicar ante el INVIMA la solicitud de la licencia. “Mientras el Invima decide sobre la solicitud de esta licencia, podrán continuar con las actividades de fabricación de derivados no psicoactivos de cannabis”, señalaron. 

    Tipos de licencias: 

    ¿Qué pasa con los cupos de los productos?

    En cuanto a los cupos, el ministerio aclaró que se podrá cambiar la modalidad de un cupo. “Se podrá cambiar de modalidad en los cupos de cultivo siempre y cuando el producto a obtener sea el mismo aprobado en el cupo inicial”. 

    También se delimitó la cantidad de cupos suplementarios, para permitir que la industria inicie las actividades con más rapidez, ya que los mismos no precisan de una justificación por parte de los licenciatarios. En este sentido, para exportar cannabis, hasta tanto estén las actualizaciones en las modalidades, quienes quieran hacerlo podrán utilizar la modalidad de fabricación de derivados de cannabis.

    Según adelantaron desde la Cartera, los cupos ordinarios tendrán una vigencia de dos años desde que se entregan y los suplementarios una vigencia de un año.

    Por otro lado, el Ministerio de Salud explicó que se considerará un pequeño o mediano cultivador a toda persona natural colombiana con ingresos brutos anuales hasta de tres mil quinientas Unidades de Valor Tributario (3.500 UVT) y que, además, cuente con activos totales no mayores a once mil doscientos cincuenta Unidades de Valor Tributario (11.250 UVT).
