    Mar del Plata: fallo judicial permite la tenencia de 50 gramos de cannabis

    Por medio de un fallo de la Sala I del Tribunal de Casación Penal de la provincia de Buenos Aires, la cual se encuentra a cargo de Daniel Carral y Ricardo Maidana, se determinó que la policía de la ciudad de Mar del Plata no podrá trasladar a comisarías a usuarias y usuarios de estupefacientes de cualquier tipo siempre que sean para uso personal.  

    La decisión judicial se da en el inicio de la temporada de verano, siendo este el momento donde se dan la mayor cantidad de detenciones a personas por tenencia en el marco del Operativo Sol de cada año. 

    CONTEXTO 

    En 2019, la Asociación Marplatense de Cannabicultores presentó un habeas corpus para que cesen las detenciones a usuarias y usuarios de la planta. El mismo fue presentado ante el juez de Garantías Juan Tapia, quien falló a favor y sostuvo que no se podrá detener a personas que transporten consigo hasta 50 gramos de cannabis. 

    Al tiempo del fallo favorable de Tapia, la Cámara de Apelaciones lo rechazó a pedido de la Fiscalía de Estado Bonaerense. Finalmente, y siguiendo el proceso legal, quedó todo en manos del Tribunal de Casación Penal.

    Los magistrados Daniel Carral y Ricardo Maidana, concluyeron que la tenencia para consumo personal no afecta a terceros y las detenciones sin control judicial pueden poner en riesgo garantías fundamentales de los ciudadanos.

    QUÉ CANTIDADES SE PERMITEN

    El tribunal ratificó el protocolo por el cese de las detenciones y la tenencia de sustancias psicoactivas para consumo personal. El mismo establece las cantidades para cada sustancia. La cocaína hasta 5 gramos; el éxtasis o MDMA hasta 0,5 gramos o 3 pastillas; las anfetaminas, 3 gramos o 5 pastillas; el LSD, hasta 0,150 gramos; los barbitúricos, hasta 20 gramos; y los opioides, el equivalente a un gramo de morfina. 

    Es importante aclarar que las sustancias pueden ser incautadas pero, en caso de que no superen la cantidad establecida, no se podrá iniciar ningún tipo de causa contra la persona. 

    ACTUALIDAD

    El abogado Franco Bertolini fue el encargado de redactar el hábeas corpus, celebró la decisión de Casación Penal: “No teníamos ninguna duda en cuanto a lo jurídico porque toda la evidencia y la propia declaración de los funcionarios judiciales que participaron demostraron que hay una amenaza concreta en la calle cuando un policía te para, te hace una requisa y te lleva a una comisaría sin ningún control judicial”, le comentó Bertolini a la Revista THC. 

    Por su parte, la defensora pública bonaerense Victoria Baca Paunero asegura que los jueces están reforzando el fallo Arriola, dictado por la Corte Suprema de Justicia en  2009, en el que declaró que es inconstitucional penar la tenencia para consumo personal.

    «Se están reconociendo que estos procedimientos policiales afectan los derechos humanos. Se demostró una situación de gravedad suficiente que justificó una acción -el hábeas corpus colectivo- que beneficiará a personas que ni siquiera saben que serán beneficiadas”, dijo en diálogo con la Revista THC la integrante del Centro de Estudios de la Cultura Cannábica (Cecca).
