    El proyecto de ley para la industrialización del cannabis ya está en el Senado

    El proyecto de ley para dar un marco regulatorio al desarrollo de la industria del cannabis medicinal y del cáñamo industrial, con el cual el Gobierno busca reactivar la economía post pandemia, y en cuatro años generar unos 10.000 puestos de trabajo, ya tiene lugar en los despachos del Congreso. Pasará por las Comisiones de Seguridad Interior y Narcotráfico; Presupuesto y Hacienda; Agricultura Ganadería y Pesca.

    Sorpresivamente el proyecto de ley, que prevé que la planta mueva USD 500 millones de consumo interno de sus productos y USD 50 millones en exportaciones, no ingresó por Diputadas, sino que fue presentado en el Senado, la cámara que contiene equitativamente la representación de las provincias.

    Según pudo constatar Cannábica Argentina, con fuentes allegadas al parlamento, el pedido de ser tratado en primera instancia por el Senado, fue iniciativa del Gobierno para dar lugar a los expuesto por  los gobernadores sobre “rever la conformación de La Agencia (ARICCAME) y que sea más federal”. Esta posición se escuchó en la presentación del proyecto por parte del gobernador de la Rioja, Ricardo Quintela, ante los ministros y el Consejo Económico y Social.

    El gobernador de La Rioja, Ricardo Quintela, junto al presidente de la empresa estatal Agrogenética Riojana, Benjamín Enrici.

    “Simplemente hay un detalle a conversar, que es la conformación de La Agencia, que concentra la mayoría de sus integrantes en la Capital Federal, creo que la voluntad política del presidente es la federalización”, expuso el gobernador riojano, quien acompañado por el presidente de la empresa estatal Agrogenética Riojana, Benajmin Enrici, criticó el centralismo de la misma.

    El impacto de las decisiones de La Agencia se verá en el total de la cadena de industrialización, pero tendrá un impacto primordial al momento de otorgar licencias, esto determinará que empresas podrán producir en las distintas provincias, por lo cual determinará la participación privada junto a la participación de las empresas estatales: “Por eso queremos la posibilidad de decidir quiénes son los inversores y como sale el producto de nuestra provincia, no queremos que salga la flor y vuelva un producto industrializado”, apuntó el gobernador Quintela.

    “Simplemente hay un detalle a conversar, que es la conformación de La Agencia, que concentra la mayoría de sus integrantes en la Capital Federal, creo que la voluntad política del presidente es la federalización”

    Sobre este concepto también coincidió el gobernador jujeño, Gerardo Morales, aunque más moderado pidió, basándose en el derecho constitucional, que la autoridad de ley para la aplicación de la norma sean las provincias y luego tengan el visto bueno de La Agencia.

    LA AGENCIA

    El proyecto propone una fuerte presencia estatal en el mercado, mediante la creación de la ARICCAME, que centralizará de forma nacional todos los procesos desde la inscripción para obtener la licencia hasta la exportación de productos. Tendrá autarquía nacional y dependerá de la Jefatura de Gabinete, que por designación del Poder Ejecutivo, se compondrá de cinco miembros con rango de Secretaría.

    Tendrá como función regular y reglamentar la importación, exportación, cultivo, producción industrial, fabricación, comercialización y adquisición, por cualquier título de semillas de la planta de cannabis, del cannabis y de sus productos derivados con fines medicinales o industriales. Con respecto a las semillas, el Instituto Nacional de Semillas (INASE), regulará la trazabilidad de los productos vegetales y en coordinación con la ARRICCAME, dará lugar al registro de nuevas especies con derecho de autoría.

    PYMES Y PEQUEÑOS PRODUCTORES

    Sobre un contexto de crisis social y económica, el proyecto buscará dar prioridad a economías regionales, cooperativas y pequeñas y medianas empresas –donde también podrían incluirse los grow shops que ya comercializan estos productoras- atendiendo sus solicitudes principalmente, apoyo técnico y disminución de tasas, pero «asimismo la inclusión de la perspectiva de género y diversidad en su otorgamiento», así se desprende del proyecto. Para este fin, se trabajará en conjunto con el Instituto Nacional de Asociativismo y Economía Social (I.N.A.E.S). Además la reglamentación prevé un programa especial destinado a los emprendimientos de las ONG de la sociedad civil que han desarrollado saberes, conocimientos y por experiencias propias y militancia acerca de los diversos usos medicinales, terapéuticos y paliativos de la planta del cannabis.
