    Catamarca aplicó la Ley de Cannabis Medicinal por primera vez

    El fallo del Tribunal Oral de Catamarca siembra un precedente y jurisprudencia.

    El Tribunal Oral Federal de Catamarca sentó precedente y sobreseyó a un joven de 27 años aplicando la Ley de Cannabis Medicinal. El joven, que estaba imputado por tenencia de estupefacientes con fines de comercialización, obtuvo el permiso del Estado para cultivar con fines medicinales después del inicio del proceso penal, pero se consideró que debía aplicarse la ley penal más benigna.

    En diálogo con Catamarca12, el juez federal Juan Carlos Reynaga, explicó que “No hubo juicio, el fiscal hizo un dictamen por escrito solicitando el sobreseimiento y se realizó una audiencia con todas la partes. 

    Ahí el abogado defensor acreditó la tenencia con fines medicinales. Esta es la primera vez que el Tribunal hace una audiencia y apela a ley de Cannabis, por lo que puede sentar un precedente para los abogados”, contó.

    Desde la defensa, representada por el abogado Santiago Kozicki explicaron que el joven sobreseído era investigado penalmente por el delito de comercialización de drogas previsto en la Ley 23.737 desde el año 2021.

    “Lo interesante del caso es que se resolvió el sobreseimiento, no porque el hecho no haya existido o el muchacho no haya participado en él, sino porque se entendió que la situación encuadraba en la Ley de Cannabis Medicinal y que, a pesar de que el joven obtuvo el permiso del Estado para cultivar con fines medicinales después del inicio del proceso penal, se consideró que debía aplicarse esa ley por el principio -de lo que en el derecho penal- se conoce como ley penal más benigna. Se trata del primer precedente en la Provincia de Catamarca”, dijeron.

    Esto sucedió a partir de una presentación que hizo la defensa ante el Tribunal Oral y que fue acompañada por la Fiscal Federal – Rafael Vehils Ruiz-. “Desde ese momento, el caso empezó a correrse de los límites punitivos y se lo comenzó a mirar desde una perspectiva de salud. 

    La causa se había iniciado en 2021 a partir de una denuncia anónima, la cual dio lugar a un allanamiento donde se encontró una siembra de cannabis doméstica y una cosecha de cannabis de aproximadamente 350 gramos”.

    La Ley 27350 de Cannabis Medicinal  fue aprobada en el 2018 por el Congreso de la Nación y reglamentada por el Poder Ejecutivo en el 2020. Permite a las personas que cuenten con indicación médica que se inscriban en el Registro del Programa de Cannabis del Ministerio de Salud de la Nación (REPROCANN), cultivar hasta 9 plantas en floración en su domicilio con fines medicinales.

    En este caso, el joven sobreseído, “después del inicio de la causa tramitó su permiso debido a un cuadro de ansiedad e insomnio crónico y por resultar su organismo refractario a los tratamientos farmacológicos con pastillas antipsicóticas y relajantes. 

    El Ministerio de Salud estudió la documentación y el trámite concluyó de manera exitosa. Se encuadró su situación dentro de las previsiones de la Ley de Cannabis Medicinal y se lo autorizó a cultivar con dichos fines en su casa. Esta documentación se presentó en el expediente judicial y fue lo que permitió el cambio de perspectiva sobre un mismo hecho y el sobreseimiento del joven”, contaron.

    No obstante, “al inicio del proceso penal el joven estuvo privado de su libertad un mes y medio y se le secuestraron todos los elementos que utilizaba para su cultivo medicinal. Si bien ese mes y medio privado de su libertad nadie se lo va a devolver ni compensar, se consiguió que la fiscal acompañe no solo el sobreseimiento del joven sino también el pedido de restitución de los objetos secuestrados al momento del hecho”, explicaron.

    Según dijeron , en el expediente se ponderó la opinión de especialistas en medicina de cannabis como Celeste Romero y Marcelo Morante quienes en el libro Cannabis Medicinal explicaron que “muchos fármacos sintéticos poseen efectos muy puntuales y muchas veces sus usos generan nuevos desequilibrios en el cuerpo, (…) en cambio, con el cannabis se logra con una misma herramienta tratar diferentes síntomas a distintos niveles, acción que se orienta a recuperar el equilibrio y la autorregulación natural del cuerpo”.
